(Amendment)

I, GORDON GLEN DENTON SCHOLES, the Minister of State for Territories, hereby make the following Regulations under the Cemeteries Ordinance 1933.

Principal Regulations

1. In these Regulations, "Principal Regulations" means the Canberra

Public Cemeteries Regulations.

Interpretation

2. Regulation 2 of the Principal Regulations is amended by inserting after

the definition of "lawn burial area" the following definition:

" 'Ordinance' means the Cemeteries Ordinance 1933".

Fees

3. Regulation 6 of the Principal Regulations is amended—

(a) by omitting sub-regulation (1) and substituting the following

(b) by omitting from sub-regulation (2) "The fees and charges" and substituting "Determined fees";
(c) by omitting from sub-regulation (3) "for fees or charges under these Regulations" and substituting "under these Regulations in respect of a determined fee";
(d) by omitting from sub-regulation (4) "or charges";
(e) by omitting from sub-regulation (5) "or charge" (wherever occurring);
(f)
by omitting from sub-regulation (6) "or charges";

sub-regulation:

"(1) The fee determined in respect of a specified matter is payable

in respect of that service or matter.";

(g)

by omitting sub-regulation (7) and substituting the following sub-regulation:

"(7) Where—

(a)

in relation to a burial or to an interment of ashes, a person has paid the fee determined in respect of the provision of a plaque; and

(b)

a headstone is erected on the allotment in which that burial or interment took place within the period of 2 years commencing on the day on which the burial or interment took place,

the Trustees shall, on the application of the person referred to in paragraph (a),

refund to the person the amount fixed in respect of the provision of a plaque.".

Exclusive rights to burial

4. Regulation 15 of the Principal Regulations is amended—

(a)

by omitting from sub-regulation (3) "prescribed" and substituting "determined"; and

(b)

by omitting from sub-regulation (6) "prescribed" and substituting "determined".

5. Regulation 15A of the Principal Regulations is amended by omitting

from sub-regulation (2) "prescribed" and substituting "determined".

Inspection of register

6. Regulation 17 of the Principal Regulations is amended by omitting from

sub-regulation (2) "prescribed" and substituting "determined".

Removal of dead body

7. Regulation 26 of the Principal Regulations is amended by omitting from

paragraph (1) (a) "prescribed" and substituting "determined".

Repeal of Schedule 2

8. Schedule 2 to the Principal Regulations is repealed. NOTES
