    Editorial changes

    The Legislation Act 2001, part 11.3 authorises the Parliamentary Counsel to make editorial amendments and other changes of a formal nature when preparing a law for republication.  Editorial changes do not change the effect of the law, but have effect as if they had been made by an Act commencing on the republication date (see Legislation Act 2001, s 115 and s 117). The changes are made if the Parliamentary Counsel considers they are desirable to bring the law into line, or more closely into line, with current legislative drafting practice.

    This republication does not include amendments made under part 11.3 (see endnote 1).

    Uncommenced provisions and amendments

    If a provision of the republished law has not commenced or is affected by an uncommenced amendment, the symbol  U  appears immediately before the provision heading.  The text of the uncommenced provision or amendment appears only in the last endnote.

    Modifications

    An Act to validate certain fees

    1. Name of Act

      This Act is the Canberra Institute of Technology (Validation of Fees) Act 2006.

    2. Dictionary

      The dictionary at the end of this Act is part of this Act.

      Note 1The dictionary at the end of this Act defines certain terms used in this Act.

      Note 2A definition in the dictionary applies to the entire Act unless the definition, or another provision of the Act, provides otherwise or the contrary intention otherwise appears (see Legislation Act, s 155 and s 156 (1)).

    4. Validation of fees—1993 to 1998

      (1)This section applies to course fees at the Canberra Institute of Technology for the years 1993 to 1998.

      (2)The course fees set out in schedule 1 and mentioned in table 5.1, column 1 are taken to be, and always to have been, valid for all purposes as if the fees had been properly—

      (a)made under the provision mentioned in table 5.1, column 2; and

      (b)notified under the provision mentioned in table 5.1, column 3; and

      (c)laid before the Legislative Assembly under the provision mentioned in table 5.1, column 4.

    1. Validation of fees—1999 to 2001

      (1)This section applies to course fees at the Canberra Institute of Technology for the years 1999 to 2001.

      (2)Course fees of $6.00 for each registered billing point are taken to be, and always to have been, valid for all purposes as if the fees had been properly—

      (a)made under the Canberra Institute of Technology Act 1987, section 53; and

      (b)notified under the Subordinate Laws Act 1989, section 6 (1) (a); and

      (c)laid before the Legislative Assembly under the Subordinate Laws Act 1989, section 6 (1) (c).

    2. Validation of fees—2002 to 2005

      (1)This section applies to course fees at the Canberra Institute of Technology for the years 2002 to 2005.

      (2)Course fees of $6.00 for each registered billing point are taken to be, and always to have been, valid for all purposes as if the fees had been properly—

      (a)made under the Canberra Institute of Technology Act 1987, section 53; and

      (b)notified under the Legislation Act, section 61; and

      (c)presented to the Legislative Assembly under the Legislation Act, section 64 (1).

    3. Expiry of Act

      This Act expires on the day after its notification day.

      NoteIf a law validates something that is or may otherwise be invalid, the validating effect of the law does not end merely because of the repeal of the law (see Legislation Act, s 88 (1) (b)).

    billing point, in relation to a course, means the larger of—

    (a)2; and

    (b)the number worked out by dividing the billing hours for the course in the CATALOG module by 5 and rounding the quotient up to the next whole number.

    Canberra Institute of Technology means the Canberra Institute of Technology under the Canberra Institute of Technology Act 1987.

    CATALOG module, in relation to a year, means the list of courses included in a program of study provided by the Canberra Institute of Technology in that year.

    registered billing point, in relation to a course in a year, means a billing point for a course in which a student registered in that year.
