1      Name of plan

This plan is Campbelltown Local Environmental Plan No 223.

2      Aims of plan

The aims of this plan are:

(a)	to permit, with the consent of Campbelltown City Council, the carrying out of development on the land to which this plan applies for the purpose of a resource recovery facility, and
(b)	to require that the facility meets all environmental standards imposed by or under an Act and does not impinge on the amenity of land in its immediate vicinity zoned or used for residential, recreation or community purposes and that the facility’s buildings and landscaping are so designed and located as to minimise any adverse effects of the facility on the environment, and
(c)	to provide that consent must not be granted to development for any other purpose on the land to which this plan applies.

3      Land to which plan applies

This plan applies to Lot 1102, DP 883495, Glenlee Road, Menangle Park, as shown edged heavy black on the map marked “Campbelltown Local Environmental Plan No 223” deposited in the office of Campbelltown City Council.

4      Amendment of Interim Development Order No 15—City of Campbelltown

Interim Development Order No 15—City of Campbelltown is amended as set out in Schedule 1.

Insert after clause 18:

18A Restricted development, Glenlee Road, Menangle Park

Despite any other provision of this plan, consent must not be granted to development, other than development for the purpose of a resource recovery facility, on Lot 1102, DP 883495, Glenlee Road, Menangle Park, as shown edged heavy black on the map marked “Campbelltown Local Environmental Plan No 223” deposited in the office of the Council.

Omit the item of Schedule 3 that refers to the map marked “Campbelltown

Local Environmental Plan No. 202”.

Insert instead:

Lot 1102, DP 883495, Glenlee Road, Menangle Park, as shown edged heavy black on the map marked “Campbelltown Local Environmental Plan No 223” deposited in the office of the Council—a resource recovery facility, subject to the following conditions:

(a)

the facility meets all environmental standards that are imposed by or under an Act, and

(b)

the facility does not impinge on the amenity of any land in its immediate vicinity:

(i)	that is zoned for residential, recreation or community purposes, or
(ii)	that is used for residential, recreation or community purposes, and

(c)

the facility’s buildings and landscaping are so designed and located as to minimise any adverse effects of the facility on the environment.

In this item, resource recovery facility means a facility that is used for either or both of the following:

(a)	the recovery, reuse and recycling of organic waste materials,
(b)	the production of fuels, energy or products from organic waste materials.
