Campbell Henderson v Director of Public Prosecutions (SA)
[2023] HCASL 179
CAMPBELL HENDERSON
v
DIRECTOR OF PUBLIC PROSECUTIONS (SA)
[2023] HCASL 179
A13/2023
The applicant seeks an extension of time within which to apply for special leave to appeal from a decision of the Court of Appeal of the Supreme Court of South Australia (Livesey P and David JA; Nicholson AJA dissenting) granting the Crown permission to appeal against the applicant's sentence on a count of aggravated causing death by dangerous driving, contrary to s 19A(1) of the Criminal Law Consolidation Act 1935 (SA), as manifestly inadequate and allowing the appeal.
The proposed grounds of appeal do not raise a question of general principle warranting the attention of the Court, and it would be futile to grant the extension of time sought.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
