1. The applicant seeks special leave to appeal from part of the judgment of the Court of Appeal of the Supreme Court of New South Wales (Ward P, Gleeson and Adamson JJA), dismissing in part the applicant's appeal from judgments of the Supreme Court of New South Wales (Henry J).

2. The proposed appeal raises a question of law of public importance. However, the proposed appeal is not an appropriate vehicle for this Court to determine that question.

3. Special leave to appeal is refused with costs.
