I, the Minister for Planning and Infrastructure, make the following local environmental plan under the Environmental Planning and Assessment Act 1979.

1      Name of Plan

This Plan is Camden Local Environmental Plan 2010 (Amendment

No 1).

2      Commencement

This Plan commences on the day on which it is published on the

NSW legislation website.

3      Land to which Plan applies

This Plan applies to land to which Camden Local Environmental Plan

2010 applies.

4      Maps

Each map adopted by Camden Local Environmental Plan 2010 that is specified in Column 1 of the following Table is declared by this Plan to be amended or replaced by the map specified opposite in Column 2 of the Table as approved by the Minister on the making of this Plan.

Environmental Plan 2010

[1]      Clause 4.1A Exceptions to minimum lot sizes for certain residential development use

Omit “Area 1 at Manooka Valley,” from clause 4.1A (2).

[2]      Clause 4.1A (3) (b)

Omit the paragraph.

[3]      Clause 4.1B

Insert after clause 4.1A:

4.1B

Exception to minimum lot sizes for certain land at Lakeside Urban

Release Area

(1) This clause applies to land in Zone E2 Environmental Conservation and Zone RE2 Private Recreation in the urban release area shown as “Lakeside” on the Urban Release Area Map.

(2)

Clause 4.1 does not apply in relation to the subdivision of any

land to which this clause applies.

(3)

Development consent must not be granted for the subdivision of land to which this clause applies unless the Council is satisfied that the proposed subdivision facilitates the development of land in Zone R1 General Residential in the urban release area shown as “Lakeside” on the Urban Release Area Map.

[4]      Clause 6.1 Arrangements for designated State public infrastructure

Omit clause 6.1 (2). Insert instead:

Development consent must not be granted for the subdivision of

land in an urban release area:

(a)	if the subdivision would create a lot smaller than the minimum lot size permitted on the land immediately before the land became, or became part of, an urban release area, or
(b)	in the case of land in Zone R1 General Residential in the urban release area shown as “Lakeside” on the Urban Release Area Map—if the subdivision would create a lot with an area of less than 40 hectares,

unless the Director-General has certified in writing to the consent authority that satisfactory arrangements have been made to

contribute to the provision of designated State public

infrastructure in relation to that lot.

[5]      Schedule 1 Additional permitted uses

Insert after clause 25:

26 Use of certain land at Mount Annan

(1)

This clause applies to land at Annanvale Circuit, Holdsworth Drive and Waterworth Drive, Mount Annan, being Lot 206, DP 1070297 and Lots 1 and 5, DP 1129436.

(2)

Development for the purposes of multi dwelling housing is

permitted with development consent.

[6]      Schedule 5 Environmental heritage

Omit “Lot 2, DP 560048” from the matter relating to “Hilsyde”, 56 Hilder

Street, Elderslie in Part 1.

Insert instead “Lot 1, DP 1142209”.
