GLEESON CJ:   In this matter the Court has been informed that the first respondent does not wish to be represented at the hearing of the application for special leave and will submit to any order of the Court save as to costs, and the Court has also been informed that neither the applicant nor the second respondent desires to make any oral submissions.

The Court is of the view that the application for special leave should be refused on the basis that there are no sufficient prospects of success of an appeal.  The application for special leave to appeal is refused.
