TIHEELCIAEI.RINI.S An Act to Transfer to and Vest in the Cairns Sub WELCOME HOME CLUB TRANSFER Branch of The Returned Sailors, Soldiers A.O1T95O2F. and Airmen's Imperial League of Australia, Queensland Branch, the Lands and other Property of The Welcome Home Club at Cairns. . [ASSENTED TO 16TH OCTOBER, 1952.] W HEREAS by Nomination of Trustees dated the thirty-first day of January, one thousand nine hundred and twenty, and registered in the office of the Deputy Registrar of Titles at Townsville as Number N84844, George Russell Mayers transferred all his estate or interest in all that piece or parcel of land situate in the County of Nares, Parish and Town of Cairns, containing 1 rood, described as Allotment 19 of Section 9 and being the whole of the land contained in Deed of Grant Number N5358, Volume 122, Folio, 171, to James Steven Gomm and Walter Henry Gibbs as Trustees of the same, upon such trusts and for such purposes and with and subject to such powers and provisions as were declared by and in a certain Deed of Trust dated the first day of August, one thousand nine hundred and nineteen, made between Arthur Sidney Booker, Walter Henry Gibbs and Isabella Euphemia McLaren of the one part and James Steven Gomm and Walter Henry Gibbs of the other part: AND WHEREAS by the said Deed of Trust dated the first day of August, one thousand nine hundred and nineteen, it was provided inter alia that the Trustees of the said land and property should hold the same (being the Rest Home of the Welcome Home Club) upon trust to permit the same to be used and enjoyed by all the Returned Sailors and Soldiers in the Cairns District (as more particularly defined in the said Deed) as a Rest and Recreation Home or for such other purposes for the benefit of the said Sailors and Soldiers as the Committee thereinafter mentioned might from time to time determine:

Cairns Welcome Home Club Transfer Act. 475 AND WHEREAS Gilbert Brown MacGregor and Clive Kynaston are or are entitled to be the registered proprietors of an estate in fee-simple in the said lands under and by virtue of the said Nomination of Trustees Number N84844 and the Schedule of Trusts thereto: AND WHEREAS it is desirable to empower and authorise the said Gilbert Brown MacGregor and Clive Kynaston (or the Trustees for the time being under the said Nomination of Trustees) to do and execute all such acts, matters and things as are proper to transfer the said lands and other property comprised in the said Trust to the Cairns Sub-Branch of The Returned Sailors, Soldiers and Airmen's Imperial League of Australia, Queensland Branch, in the manner required by law: Be it therefore enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same as follows :- 1. This Act may be cited as " The Cairns Welcome Short Title. Home Club Transfer Act of 1952." 2. (a) Upon the passing of this Act, the lands Property of and other property of the Cairns Welcome Home Club wthelceeamime8 as mentioned and defined in the said Nomination of Home Club Trustees Number N84844 and the Schedule of Trusts ttroarckaafizsed tohfeAreutogaunsdt, tohneesathidoDuseaenddonf iTnreushtudnadtereddthaenfdirnstindeatyeeSnu, bg-Bettnurerannedch shall, as from the date of such passing and by virtue sailors, of this Act, without any conveyance, transfer, or sAcimizsand assignment, except as otherwise provided in this section, Imperial be divested from the Trustees of the same, and the AL=ica'f. objects of the Trust created in respect thereof, and vest in the Cairns Sub-Branch of The Returned Sailors, Soldiers and Airmen's Imperial League of Australia, Queensland Branch, upon the Trusts for which the said Sub-Branch may hold lands and other property under and subject to the constitution, rules and by-laws of the said League, but absolutely freed and discharged from the Trusts upon and subject to which the said lands and other property have heretofore been held.
476 BUILDINGS. Cairns Welcome Home Club Transfer Act. 1ELT.z. II., 1952. (b) The said Gilbert Brown MacGregor and Clive Kynaston (or the Trustees for the time being under the said Nomination of Trustees) may, and are hereby authorised to, by a Nomination of Trustees duly made and executed in accordance with the provisions of *"The Real Property Acts, 1861 to 1946," transfer to Trustees of the Cairns Sub-Branch of The Returned Sailors, Soldiers and Airmen's Imperial League of Australia, • Queensland Branch, the estate in fee-simple in the said lands to be held by such lastmentioned trustees upon the trusts for which that Sub-Branch may hold lands and other property under and subject to the constitution, rules and by-laws of the said League, but absolutely freed and discharged from the trusts upon and subject to which such lands have heretofore been held. Trustees to 3. Any property which is vested in the said staukbejelcatntdos Sub-Branch or Trustees for the same by virtue of this existing Act shall be so vested subject to any debt, liability, or liabilities. obligation specially charged on or affecting the same. On and after the date of the passing of this Act neither the said Welcome Home Club nor the Trustees of the said land and premises shall be subject to any liability in respect of any debt, liability or obligation hereinbefore in this section mentioned, but every such liability shall, on and after such date, be imposed on and discharged by the said Sub-Branch. * 25 G. 5 No. 14 and amending Acts.
