[ASSENTED TO l:tTH DECEMBER, 1906.J W HEREAS by a deed of grant dated the twenty-sixth Preamble. day of May, one thousand eight hundred and ninety-one, and numbered ~ 2760, all that parcel of land in the State of Queensland containing two roods, situated in the county of Nares, parish and town of Cairns, being allotments numbers nine and ten of section eight (herein- after referred to as "the said land"), and more particularly described in the said deed of gl'ant, was granted to Robert r:r;aylor Hartley, Daniel Patience, and Alexander Frederick John Draper, all of Cairns aforesaid, upon trust for a School ot'Arts, and for no other purpose whatsoever: And whereas on the thirty-first day of July, one thousand nine hundred and one, the said Daniel Patience resigned his said trust, and on the twelfth day of December, one thousand ij.ine hundled and one, William John Munro, of Cairns aforesaid, was duly appointed to be a Trustee of the said land in the room of the said Daniel Patience: And whereas the said land is now vested in the said Robert Taylor Hartley, Alexa,nder .Frederick John Draper, and William John Munro as such Trustees as afoeesaid: And whereas the said Trustees are desirous of mortgaging the said land to an amount not exceeding two thousand five hundred pounds, and -applying the moneys so raised towards the erection on the said land of a building to be

VII. .N o. 22, 1906. used for the purposes of the said trust: And whereas it is anticipated that the revenue to be derived from so much of the said building as is not immediately used as a School of Arts will be sufficient to provide the interest due from time to time in respect of the said mortgage moneys and to repay the said mortgage moneys at the aue date thereof: And whereas it is desirable that the aforesaid powers should he conferred upon the said 'frustees subject to the conditions by this Act prescribed: Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legis- lative Assembly ef ~ueensland in Parliam.ent assembled,:, and by the authority of the same, as follows :-' Short tit.le. 1. This Act may be cited as " The OdJi'NfIJ 8clwol of Artlf .Act of 1906." Interpreta- tion. 2. In this Act thE" term "the Trustees" means and incluaes the said Robert Taylor Hartley, Alexander Frederick John Draper, and William John Munro, and. their successors in office who for the time being are- Trustees of the said. land.
