CaseChat Overview and Summary
The legal issues before the Commission involved whether the proposed agreement met the requirements of the Fair Work Act 2009. Key considerations included whether the agreement provided for a safety net of minimum wages and conditions, whether it complied with relevant minimum standards, and whether it adhered to the good faith bargaining provisions. The Commission also needed to determine if the agreement was made in good faith and if it provided for the proper administration of the agreement.
In reaching its decision, the Commission considered the evidence presented by both parties. It found that the agreement provided for a safety net of minimum wages and conditions, and it complied with the relevant minimum standards. The Commission was satisfied that the agreement had been made in good faith and provided for the proper administration of the agreement. Accordingly, the Commission approved the proposed agreement, finding it to be in accordance with the relevant provisions of the Fair Work Act 2009.
The Fair Work Commission approved the CAFCO SERVICES PTY LTD AND AMWU Geelong Area Agreement 2017 - 2020, effective from 1 July 2017. The approval was made on the basis that the agreement met the statutory requirements and provided for the proper administration of the agreement.
