  1. The applicant seeks the removal to this Court of certain questions arising in proceedings in the Supreme Court of Victoria. The application does not disclose a proper basis for removal under s 40 of the Judiciary Act 1903 (Cth).

  2. The respondent seeks indemnity costs on the basis that the arguments advanced by the applicant are wholly without merit.  There is nothing in the material on which the respondent relies to justify an order for costs other than on an ordinary basis.

  3. Pursuant to r 26.07.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
