Business Names Regulations 1996

under the Business Names Act 1996

1—Short title

These regulations may be cited as the Business Names Regulations 1996.

4—Interpretation

In these regulations, unless the contrary intention appears—

Act means the Business Names Act 1996.

5—Fees

1. (1)

   The fees fixed by Schedule 1 are payable to the Commission for the purposes set out in that Schedule.

2. (2)

   The Commission may waive, reduce or refund a fee (or part of a fee) payable under these regulations if satisfied that it is appropriate to do so in a particular case.

Schedule 1—Fees

 

1	Section 8(1) of the Act—
(a) application fee for registration of a business name	$150.00
(b) application fee for renewal of registration of a business name	$120.00
(c) late application fee (in addition to the fee payable under paragraph (b))	$33.25
2	Fee for replacement of a certificate of registration	$21.60
3	Section 8(4) of the Act—application for consent of the Minister	$258.00
4	Section 11(4) of the Act—
(a) inspection of a document lodged with the Commission under this Act or the repealed Act	$21.60
(b) obtaining a copy of part of the register, a document lodged with the Commission under the Act or the repealed Act or a list of business names registered under the Act as referred to in section 11(4)—
(i) for the first sheet	$21.60
(ii) for each additional sheet	$1.20
(c) obtaining a certified copy of part of the register or of a document lodged with the Commission under the Act or the repealed Act—
(i) for the first sheet	$21.60
(ii) for each additional sheet	$1.20
5	Section 12(1) of the Act—
(a) notification of a change of proprietor of a business name	$31.25
(b) late lodgment of a notice (other than a notice of cessation of business under a business name)	$33.25
6	For any act that the Commission is required or authorised to do on the request of a person and for which a fee is not otherwise prescribed	$21.60
