Part 1—Preliminary

1—Short title

These regulations may be cited as the Business Names (Fees) Variation Regulations 2006.

2—Commencement

These regulations will come into operation on 1 July 2006.

3—Variation provisions

In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

Part 2—Variation of Business Names Regulations 1996

4—Substitution of Schedule 1

Schedule 1—delete the Schedule and substitute:

Schedule 1—Fees

1	Section 8(1) of the Act—
(a)    application fee for registration of a business name	$133.00
(b)    application fee for renewal of registration of a business name	$107.00
(c)     late application fee (in addition to the fee payable under paragraph (a) or (b))	$29.75
2	Fee for issue of a commemorative certificate of registration	$48.00
3	Fee for replacement of a certificate of registration	$19.20
4	Section 8(4) of the Act—application for consent of the Minister	$230.00
5	Section 11(4) of the Act—
(a)    inspection of a document lodged with the Commission under this Act or the repealed Act	$19.20
(b)    obtaining a copy of part of the register or of a document lodged with the Commission under the Act or the repealed Act—
(i)     for the first sheet	$19.20
(ii)    for each additional sheet	$1.05
(c)     obtaining a certified copy of part of the register or of a document lodged with the Commission under the Act or the repealed Act—
(i)     for the first sheet	$19.20
(ii)    for each additional sheet	$1.05
6	Section 12(1) of the Act—
(a)    notification of a change of proprietor of a business name	$27.75
(b)    late lodgment of a notice (other than a notice of cessation of business under a business name)	$29.75
7	For any act that the Commission is required or authorised to do on the request of a person and for which a fee is not otherwise prescribed	$19.20

Note—

As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.
