Business Names Act 1962

Business Names (Amendment) Regulations 1996

The Governor in Council makes the following Regulations:

1. Objective

The objective of these Regulations is to amend certain prescribed forms.

2. Authorising provision

These Regulations are made under section 32 of the Business Names Act 1962.

3. Principal Regulation

In these Regulations, the Business Names
Regulations (No. 2) 19921 are called the Principal

Regulations.

4. Amendments to forms

(1) In Schedule 2 to the Principal Regulations, in

Form 1—

(a)

in paragraph 3 for "Or proposes to start" substitute "or is proposed to start";

(b) in paragraph 6 omit "/Manager";

(c)

writing and have been authorised in writing
to accept service on behalf of the person/s
carrying on business under the above
Business Name of any notice for the purpose
of the Business Names Act 1962 and of any
process." substitute—

in paragraph 7 for "I have consented in resident agent of the person/s carrying on business under the above business name and have been authorised in writing by that person or those persons to accept service on behalf of the person/s of any notices for the purposes of the Business Names Act 1962 and of any process.";

(d) in paragraph 9—

(i)  after "compulsory", insert "Only insert names that you wish to register. Please select carefully. Your instructions will be followed without further contact. If you are not happy with the name that is

registered, you will need to cancel the
name and register a new one.";

(ii)  for "If my 1st preference is not available, please register one of the following preferences in order:" substitute "If my first preference is not available, please register one of the following names, listed in order of preference:".

(2) In Schedule 2 to the Principal Regulations, in

Form 4—

(a)

in paragraph 2 for "Cancel the current name and register the new name." substitute "If

you wish to carry on business under a
different business name, cancel the current

name and register the new name.";

(b)

in paragraph 3(b) after "Additional" insert "Business";

(c) in paragraph 6 omit "/Manager"; and

(d) omit paragraph 7.

(3) In Schedule 2 to the Principal Regulations, in

Form 5—

(a) for paragraph 3 substitute—

"3. Notice is hereby given that on the

__/__/__ business ceased to be carried
on in Victoria under the above
registered business name by the person
or all of the persons in relation to whom

the business name is registered."; and

(b) in paragraph 4 omit "/manager".
