(Amendment)

I, GORDON GLEN DENTON SCHOLES, the Minister of State for Territories, hereby make the following Regulations under the Business Franchise (Tobacco and Petroleum Products) Ordinance 1984.

Principal Regulations

1. In these Regulations, "Principal Regulations" means the Business

Franchise (Tobacco and Petroleum Products) Regulations.

Determination of value of tobacco
2. Regulation 3 of the Principal Regulations is amended by omitting

from sub-regulation (1) "by way of interstate trade" (wherever occurring).

Repeal

3. Regulation 4 of the Principal Regulations is repealed.

Keeping of records—petroleum products

4. Regulation 6 of the Principal Regulations is amended by omitting

sub-regulation (3) and substituting the following sub-regulation:

fuel is delivered; and

"(3) The records to be kept by a person who carries on petroleum

wholesaling are as follows:

(a)

a separate record showing details of each sale of motor spirit or diesel fuel made by the person, including—

(i) the name and, if known, the address of the purchaser;
(ii) the price at which the motor spirit or diesel fuel was sold;
(iii) the date of the sale;
(iv) the volume in litres of the diesel fuel or motor spirit sold;

(v)  in the case of the sale of motor spirit—the grade of the motor spirit;

(vi)   the address of the place to which the motor spirit or diesel

(b)

a separate record showing details of each purchase of motor spirit or diesel fuel made by the person including—

(i) the name and, if known, the address of the seller;

(ii)   the price at which the motor spirit or diesel fuel was purchased;

(iii) the date of the purchase;

(iv)   the volume in litres of the motor spirit or diesel fuel purchased;

(v)   in the case of a purchase of motor spirit—the grade of the motor spirit;

(vi)   the volume in litres of each grade of motor spirit and of diesel fuel held in stock by the person at the end of each calendar month.".
