An Act to amend the Business Franchise Licences (Petroleum Products) Act 1987 to require licence fees paid under that Act to be paid into the Roads
and Traffic Authority Fund. [Assented to 13 June 1989]

Amendment 1989

The Legislature of New South Wales enacts:

Short title

  1. This Act may be cited as the Business Franchise Licences (Petroleum

Products) (Road Funding) Amendment Act 1989.

Commencement

  1. This Act commences on a day to be appointed by proclamation.

Amendment of Business Franchise Licences (Petroleum Products) Act 1987

No. 94

3. The Business Franchise Licences (Petroleum Products) Act 1987 is

amended by inserting after section 48 the following section:

Licence fees to be paid into Roads and Traffic Authority Fund

48A. (1) In this section—

"Roads Fund" means the Roads and Traffic Authority Fund (2) There is appropriated by this section for payment out of the Consolidated Fund into the Roads Fund all amounts received on or after the commencement of this section in payment of licence fees (including penalty licence fees and interest on overdue licence fees) under this Act. established under the Transport Administration Act 1988.

Business Franchise Licences (Petroleum Products) (Road Funding)

Amendment 1989

(4) There is payable out of the Roads Fund such amounts as may

become payable under this Act—

(a)

by way of refunds of licence fees (being fees paid on or after the commencement of this section); or

(b) by way of interest payable on any such refunded licence fees.
