Bush Fires Amendment Regulations 2003

Made by the Governor in Executive Council.

1.            Citation

These regulations may be cited as the Bush Fires Amendment
Regulations 2003.

2.            The regulations amended

The amendments in these regulations are to the Bush Fires
Regulations 1954*

3.            Regulation 19 amended

Regulation 19(1) is amended by deleting "by-law" and inserting instead -

local law

4.            Regulation 38A amended

Regulation 38A(3) is amended by inserting after the subregulation -

(a) contrary to a prohibition given under subregulation (1); or

Penalty: $5 000. ".

5.            Regulation 38B amended

(1) Regulation 38B(2) is amended by deleting "Notwithstanding,
but without limiting, the foregoing provisions of this regulation
and in any event, every" and inserting instead -

Every ".

(2) Regulation 38B(3) is repealed and the following subregulation
is inserted instead -
(3) Every person who operates any power saw, bag loader
or other plant or equipment activated by an internal
combustion engine -

(b) in contravention of subregulation (2),

commits an offence.
Penalty: $5 000.

6.            Regulation 38C amended

After regulation 38C(2) the following subregulation is inserted —

(3) A person who contravenes a declaration made under

subregulation (1) commits an offence.
Penalty: $5 000.

7.            Regulation 46 replaced

Regulation 46 is repealed and the following regulation is inserted instead —

46. Breach of regulations an offence
A person who —

(a)

commits a breach of any regulation for which a penalty is not expressly provided; or

(b)

fails to comply with any condition on which a permit to burn is granted,

is guilty of an offence.

Penalty: $1 000.
