BUSH FIRES AMENDMENT ACT

No. 8 of 1987

AN ACT to amend the Bush Fires Act 1954.

[Assented to 5 June 1987]

BE it enacted by the Queen's Most Excellent Majesty, by and with the

advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1.     This Act may be cited as the Bush Fires Amendment Act 1987.

Principal Act

2. In this Act the Bush Fires Act 1954* is referred to as the principal

Act.

Section 2 repealed

3. Section 2 of the principal Act is repealed.

Section 39 amended

4. Section 39 of the principal Act is amended in subsection (2) by

deleting paragraph (b).

Section 45 amended

5. Section 45 of the principal Act is amended in paragraph (b)

(a) by deleting "has and shall" and substituting the following-

" may "; and

(b) by inserting after "operations, and" the following-

" thereupon ".

Section 47 amended

6. Section 47 of the principal Act is amended by deleting "paragraphs (a) and (b) of subsection (2) of section thirty-nine of this Act," and substituting the following

section 39 (2) (a) ".

Section 63 amended

7. Section 63 of the principal Act is amended in subsection (1) (b) by

deleting "as required by" and substituting the following-

" under ".

Various penalties amended

8. The principal Act is amended as set out in the following Table

Section 18 (12) Delete the penalty provision, substitute-

" Penalty: For a first offence $1 000 or 6 months' imprisonment or both; for any subsequent offence $4 000 or 6 months' imprisonment or both. ".

Sections 24B (3), 27 (1), Delete the penalty provision, substitute-

27 (5), 27B (1), 30 and	" Penalty: $500. ".

Sections 25 (2), 25A (4), Delete the penalty provision, substitute-

25A (7), 25B (2), 27D (2),	" Penalty: $1 000. ".
27D (3), 28 (2) and 33 (3)

Sections 27 (7) (d), Delete "two hundred dollars", substitute-

27A (1) (b) and 61 (2) " $500 ".

Section 27C (1) Insert at the foot of the subsection the following

penalty provision-

" Penalty: $500. ".

Section 27C (2) Insert after "brigade" the following-

" , in addition to or without imposing a

penalty on the offender ".

Section 32 Delete the penalty provision, substitute-

" Penalty: $4 000 or 5 years' imprisonment

or both. ".

Sections 46 (2) and 57 Delete the penalty provision, substitute-

" Penalty: $1 000 or 3 months'

imprisonment or both. ".

Section 59A (8) (b) Delete "fifty dollars", substitute-

" $200 ".
