AN ACT to amend the Bush Fires Act, 1937-1948.
[Assented to 26th October, 1949.]
BE it enacted by the King's Most Excellent Majesty,by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, hi -Ohs present Parliament assembled, and by the authority of the same, as follows:—
1. This Act may be cited as the Bush Fires Act Short title.
Amendment Act, 1949, and shall be read as one with the Bush Fires Act, 1937-1948 (Act No. 55 of 1937, as reprinted with amendments to and including No. 16 of 1942, incorporated pursuant to the provisions of the
Amendments Incorporation Act, 1938, in Volume 2 of
the Reprinted Acts of the Parliament of Western Aus- tralia, and further amended by Nos. 76 and 79 of 1948), hereinafter referred to as the principal Act.

| Section eight of the principal Act is amended by adding after subsection (3) the following subsection: | of a. 9. |

(4) Notwithstanding that permission is granted as aforesaid, nothing in this section shall be deemed to relieve any person from liability for any action- able damage sustained by any other person in consequence of the burning operations carried out pursuant to such permission.
Amendment
4. Section nine of the principal Act is amended by of S. 11.
substituting for the words "twenty-fourth day of December" in subsection (3), paragraph (a), lines six and seven, the words "fifteenth day of January".

Section eleven of the principal Act is amended by adding after the word "any" secondly occurring in subsection (3), line two, the words "actionable damage sustained by any other person in consequence of any burning operations carried out in compliance with all the conditions prescribed in subsection (1) of this section, or for".
