AN ACT to amend section nine of the Bush Fires Act,

1937-1942.

[Assented to 30th January, 1946.]

RE it enacted by the King's Most Excellent Majesty,

by and with the advice and consent of the Legis-

lative Council and Legislative Assembly of Western

Australia, in this present Parliament assembled, and by

the authority of the same, as follows :—

1.   This Act may be cited as the Bush Fires Act ncrot. to' of

cipal Act.

Amendment Act, 1945, and shall be read as one with the 1942, S. 9.

Bush Fires Act, 1937-1942 (No. 55 of 1937 as reprinted in

Volume 2 of the Reprinted Acts of the Parliament of

2.    Section nine of the principal Act is amended by otstment

inserting therein after subsection (3) a new subsection

as follows :—

(3a) During the operation of any suspension referred to in subsection (3) of this section and subject to the approval in writing of the local auth- ority in whose district the burning is to take place

and to the due observance of the conditions in section eleven of this Act, it shall be lawful for any owner or occupier of land contiguous to any railway reserve in co-operation with the Commissioner of Railways as defined in the Government Railways Act, 1904-

1939, and at and during the time or times that the

said Commissioner is setting fire to the bush on that portion of the railway reserve contiguous to the said land to set fire to the bush on any land of one chain in width on the said land of such owner or occupier between the railway reserve and a firebreak of not less than six feet wide for the purpose of protecting from damage by fire his pasture or crop.
