Bus Safety Amendment Regulations 2021
The Governor in Council makes the following Regulations:

1Objective
The objective of these Regulations is to amend the Bus Safety Regulations 2020 to make consequential amendments required due to the making of the Road Safety (Vehicles) Regulations 2021.
2Authorising provisions
These Regulations are made under sections 72, 73, 74, 75, 76 and 77 of the Bus Safety Act 2009.
3Commencement
These Regulations come into operation on 30 September 2021.
4Definitions
In regulation 4 of the Bus Safety Regulations 2020[1]—
(a)insert the following definitions—
"authorised officer has the same meaning as in regulation 5 of the Road Safety (Vehicles) Regulations 2021;
authorised vehicle inspector has the same meaning as in regulation 5 of the Road Safety (Vehicles) Regulations 2021;
VASS approval certificate has the same meaning as in regulation 5 of the Road Safety (Vehicles) Regulations 2021;";
(b)in the definition of complying lights and signs, for paragraph (b) substitute—
"(b)in the case of a bus that is not a heavy vehicle—clauses 111, 112 and 113 of Schedule 1 to the Road Safety (Vehicles) Regulations 2021;";
(c)in the definition of current certificate of roadworthiness, for "Road Safety (Vehicles) Interim Regulations 2020" substitute "Road Safety (Vehicles) Regulations 2021";
(d)in the definition of licensed bus tester, in paragraph (a), for "Chapter 6 of the Road Safety (Vehicles) Interim Regulations 2020" substitute "Part 6 of the Road Safety (Vehicles) Regulations 2021";
(e)in the definition of vehicle registration number, for "Road Safety (Vehicles) (Interim) Regulations 2020" substitute "Road Safety (Vehicles) Regulations 2021".
5Maximum number of passengers
For regulation 6(1)(c) of the Bus Safety Regulations 2020 substitute—
"(c)the carrying capacity specified—
(i)in the case of a heavy vehicle, in a certificate issued for the vehicle by an authorised officer or an authorised vehicle inspector under regulation 35(b)(i) of the Road Safety (Vehicles) Regulations 2021; or
(ii)in the case of a light vehicle, in a VASS approval certificate issued for the vehicle by an authorised vehicle inspector under regulation 35(c)(ii) of the Road Safety (Vehicles) Regulations 2021.".
6Licensed bus tester requirements
For regulation 38(1)(a) of the Bus Safety Regulations 2020 substitute—
"(a)the standards specified in a written direction given by the Secretary under regulation 251(1)(a) of the Road Safety (Vehicles) Regulations 2021; and".
