The applicant requires an extension of time within which to seek special leave to appeal from a decision of the Court of Appeal of the Supreme Court of Western Australia (Quinlan CJ, Mazza and Vaughan JJA) dismissing the applicant's appeal against conviction on one count of manslaughter.
There is no reason to doubt the correctness of the decision of the Court of Appeal. Further, given the case run by the State, this is not the appropriate vehicle to consider the issue sought to be ventilated on appeal. It would therefore be futile to grant the extension that is sought. Special leave should be refused.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
