Bursary Endowment Act 1912 (NSW)
Act No. 14, 1912.
An Act to establish a fund for bursaries tenable in secondary schools and in the Sydney University; to constitute a board of control; and for purposes consequent thereon or
incidental thereto. [4th April, 1912.]
Assembly of New South Wales in Parliament assembled, and by the BE it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative authority of the same, as follows :—
1 . This Act may be cited as the " Bursary Endowment Act,
1912."
2 . There shall be a bursary endowment fund, which shall be
constituted and controlled in pursuance of this Act.
3 . ( l ) The Minister shall pay any sums appropriated by
The Parliament for that purpose into the capital account of the said fund.
(2) The Minister shall pay any sums appropriated by Par-
liament for that purpose into the current account of the said fund.
(3) A n y person may donate any sum of money to the fund,
and such sum shall be carried to the capital account.
4 . ( l ) A board, to be called the Bursary Endowment Board,
shall be constituted as follows :—
(a) Two representatives of the University of Sydney.
(b)
Two representatives of the Department of Public Instruction, one of whom shall be the chairman.
(c)
Two representatives of the secondary schools registered under this Act.
The members of t he board shall be appointed b y t h e Governor
for a period of t h ree years , and such board under t he aforesaid name shall be a corporate body, having perpetua l succession and a common seal no twi ths tand ing a n y t h i n g contained in th is Ac t . The first appointees under subsection (e) shall be two representa t ives of secondary schools appoin ted by the Governor and shall hold office for six months .
(2) The Governor shall appoint t he chai rman of t h e board.
F o u r members of t he board shall cons t i tu te a quorum.
The chai rman shall have an original, and a cast ing vote.
(3) In t he event of t he absence from N e w S o u t h Wales of any member of the board, the Governor m a y appoint some person to act as such member dur ing such absence. The person so appointed shall bo a representa t ive of t he same body as t he member whose place he t emporar i ly fills, and th is representa t ion shall also app ly in t he event of a vacancy occurr ing by reason of t h e death , lunacy, or res ignat ion of a member .
5. The fund shall be vested in the board.
6. T h e board shall invest t h e capital account of t h e fund in
Gove rnmen t securities of N e w S o u t h Wales or such o ther securities as t he Governor m a y sanction ; but may, in pursuance of any conditions or directions imposed b y a donor, invest t he donation in any o ther securities named by him.
7. The board shall establish and mainta in bursaries ent i t l ing
t h e holders thereof to proceed ei ther to t h e Un ive r s i t y of Sydney , or to any S t a t e school, or to a secondary school regis tered under th i s A c t , and shall app ly t he in teres t of t he fund so invested and a n y

3. T h e board shall determine t he bursaries to be tenable a t the
said Un ive r s i t y and such schools respectively, and such bursaries shall
be awarded wi thou t regard to the school which the bursar has a t tended ,
provided t h a t such school is in t he S t a t e of N e w S o u t h Wales :

9. ( l ) The board shall keep a proper account of all moneys received and expended by it.
T h e board shall also each year prepare a s t a t emen t for t he
| Minis ter , | showing— |
(a)
the moneys paid into the fund from appropriations by P a r l i a m e n t ;
(b) t he moneys paid into t h e fund from pr iva te donations ;
(c) t he moneys expended ;

the bursaries allotted, the amounts of such bursaries, where they are held ; and
(e) generally such other information as the Minister may require.
(2) The Minister shall, as soon as practicable after the close
of each financial year, lay the statement so prepared before Parliament.1 0 . Any person who donates any sum to the fund may at the time of the donation specify the bursary to which he desires the interest on such sum to be applied.
The expressed desire of any such person shall be given effect to
by the board.
I f he desires that his donation should be set apart for a separate
bursary he may, with the approval of the board, give any name he
pleases to that bursary.1 1 . ( l ) The Board may make regulations which shall be subject
to the approval of the Minister—
(a)
prescribing what schools may be registered under this Act, and the conditions, which must be complied with in order to entitle a school to be so registered ;
(b) providing generally for such registration ;
(c)
prescribing the conditions on which bursaries may be given and shall be held.
The Governor may make regulations—
(d) defining the powers and duties of the board ;
(e)
providing for the method of selection of representatives on the board of secondary schools registered under this A c t ; and
(f) generally to carry out the provisions of this Act.
(2) Such regulations shall—
(i) be published in the Gazette ;
(ii) take effect from the date of the publication, or from a later
(iii) be laid before both Houses of Parliament within fourteen date to be specified in such regulations ; and days after publication if Parliament is in session, and, if not, then within fourteen days after the commencement of the next session. B u t if either House of Parliament passes a resolution at any time within fifteen sitting days after such regulations have been laid before such House disallowing any regulation, such regulation shall thereupon cease to have effect.
