The applicant requires an extension of time to seek special leave to appeal the decision of the Court of Appeal of the Supreme Court of New South Wales (Meagher, Leeming and White JJA). On proposed grounds 1 to 3, the proposed appeal presents as an inappropriate vehicle to consider the questions of principle sought to be raised. On proposed grounds 4 and 5, there is no reason to doubt the correctness of the decision of the Court of Appeal. Accordingly, there is no utility in granting the extension of time.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
