PART I. PRELIMINARY. Short title. 1. (1.) This Act may be cited as "The Bureau of Economics and Statistics Act of 1930." Parts of Act. (2.) This Act is divided into Parts as follows:- PART I.-PRELIMINARY; PART lI.-EsTABLISHMENT OF BUREAU ECONOMICS AND STATISTJCS; OF PART III.-COLLECTIqN OF STATISTICS; PART IV.-AMENDMENT OF STATISTICAJJ RETURNS ACT; PART V.-MISCELLANEOUS. Interpreta- tion. Bureau of Economics or Bureau. 2. In this Act, unless the context otherwise indicates, the following terms have the meanings set against them respectively, that is to say;- "Bureau of Economics" or " Bureau"-The Bureau of Economics and Statistics consti- tuted under this Act; the term also includes the director, or secretary, or officer of the Bureau;

No. 15, them pursuant to *" The Industrial Oonciliation and ArbitrationAct of 1929 ": Where the Court under such Acts refers to the Court constituted by a Judge and two Conciliation Commissioners the "Court" under this Act shall mean the Court so constituted. "PART 11.- ESTABLISH- MENT OF EBCUORNEOAMU IOCFS PART I I .-ESTABLISHMENT OF BUREAU OF ECONOMICS AND STATISTICS. AND STATISTICS. Constitution 3. There is hereby constituted a Bureau of ~ Burell;u of Economics and Statistics (hereinafter called the a~~nomlCs "Bureau"), which shall be a body corporate with per- StatisticlO. petual succession and capable of suing and being sued, and such Bureau shall have a common seal. All courts, judges, and persons acting judicially shall take judicial notice of the seal of the Bureau affixed to any document or notice, and shall presume that it was duly affixed. Due adminis- tration of Bureau. 4. The due conduct and administration of the Bureau shall, subject to this Act, be under the direction, supervision, and control of the Director of the Bureau (to be appointed as hereinafter provided). Appoint- ment of Director. 5. (1.) The Governor in Council may from time to time appoint, by Commission in His Majesty's name, a person to be the Director of the Bureau of Economics and Statistics (hereinafter referred to as " the Director") for a term not exceeding seven years. Disabilities. (2.) The Director shall not act as a director or auditor or in any other capacity take part in the manage- ment of any bank, joint stock company, or other financial institution, or of any trade or business; and in any such case shall be disqualified from holding the office of Director. First Director. (3.) The person holding office as Director of the Bureau of Economics and Statistics at the date of the passing of this Act shall be deemed to have been appointed Director under the powers conferred by this section on and from the date of such appointment, and a commission as aforesaid shall forthwith be issued to him as from such date. Salary. (4.) The Director shall during his continuance in office receive an annual salary to be fixed by the Governor in CounciL * 20 Geo. V. No. 28, supra, page 12565.

(5.) The Director may be suspended from his office Suspension by the Governor in Council, but shall not be removed and removal. from office except as hereinafter provided. If the Director is so suspended the Minister shall cause to be laid before the Legislative Assembly a full statement of the grounds of such suspension within seven days thereafter, if the Legislative Assembly is in session, or, if the Legislative Assembly is not in session, within seven days after the commencement of the next ensuing session of the Legislative Assembly. The Director so suspended shall be restored to office unless the Legislative Assembly, within twenty-one days from the time when such statement has been laid before it, declares by resolution that the Director ought to be removed from office; and, if within the said time the Legislative Assembly so declare, the Director shall be removed by the Governor in Council accordingly. h I · S 0 ( f6fi. c) eT- he Director shall be deemed to have vacated ovOtafhcfieacr. etwehdiso. ew (a) If he is or becomes disqualified under this Act from holding the office of Director ; (b) If without the express permission of the Governor in Council he engages during his term of office in any employment outside the duties of his office '; (c) If he becomes insolvent or institutes proceed- ings for liquidation of his affairs by arrange- ment or composition with or assigns his salary for the benefit of his creditors; (d) If he absents himself from duty for a period of fourteen consecutive days except on leave granted by the Minister (which leave is hereby authorised to be granted), or becomes incapable of performing his duties. (7.) In the case of suspension or death of the Director, the Minister by notification in the Gazette shall appoint some person who shall have and exercise all the powers, functions, and authorities and perform an the duties of the Director, and be deemed for the purposes of this Act to be the Director until in the case of suspension the Director has been restored to office, or until in the case of suspension and removal from office after suspension or death the Governor in Council has appointed a person to be Director: Provided, however, that an appointment made by the Minister under this subsection shall not be for a longer period than six months, but if necessity arises a further appointment of the same or another person may be made by the Minister for the like purpose for another period not exceeding six months. Officers. 6. (1.) The Governor in Council may appoint a. secretary, and may appoint and employ such adminis- trative and technical officers and other employees to assist in the execution of this Act as may be necessary, and shall pay to such secretary, officers, and employees such salaries as he thinks fit. (2.) The Secretary shftll have power to execute documents on behalf of the Director, and affix the official seal thereto, and shall also have such other powers and perform such other duties as are from time to time imposed and directed by the Director: Provided always that an officer of the Public Service may, in addition tOo the position which he holds at the commencement of this Act, be appointed also to perform such other duties under this Act as the Governor in Council may direct or as may be prescribed, and in respect of the performance of such duties shall be deemed to be an officer of the Bureau: Provided further that any officer appointed under this Act may hold his office under this Act in conjunction with any other office which he may hold at the commence- ment of this Act.

There is hereby appropriated from the Consolidated Revenue Fund a sum of five thousand PART 11.- ESTABLISH- MENT OF BUREAU OF ECONOMICS AND STATISTICS. pounds per annum to be paid quarterly into a Trust Constitution Fund to be entitled "The Bureau of Economics and ~ ~ ~ ~ st Statistics Trust Fund," hereinafter referred to as "The Fund." (2.) The administration of the Fund shall be under the control of Trustees, who shall be the Director, the Under Secretary Department of Labour and Industry, and the Public Service Commissioner. (3.) All costs, charges, and expenses incurred in the conduct and administration of the Bureau shall be defrayed out of the Fund, including the salaries of the officers appointed under section six hereof, but not including the salary of the Director, or the expenditure of the Registrar-General: Provided, however, that any further expenditure shall be approved by the Minister and shall be provided from moneys appropriated by Parliament. 8. (1.) The powers and functions and responsi- Powe~ s and b I 'll'ti' es 0 f the Bureau sha11 be t 0 acquI.re and d I ' S semI.nat e fBuunrcetIaOun. s of knowledge concerning the economic conditions of Queens- land, including the income, production, and industrial efficiency of the community, to collect statistical and, other information relating thereto, and in particular to report on- (a) The organisation, capitalisation, and labour conditions of particular industries; (b) The trade of Queensland, both oversea and interstate; (c) Stock of commodities, both primary and manufactured; (d) Monetary conditions and both wholesale and retail prices; (~ ) Employment and unemployment generally, and in particular industries and localities; (f) The relations between employers and em- ployees; and (g) Any other matter, including any questions of unfair competition, or of sweating, or of monopolies detrimental to the public or to any section thereof, which the Minister or th~ Bureau may consider to be in the public interest and to further the objects of this Act.

Further powers of Inquiry Bureau. (3.) In addition to and without limiting the powers, duties, and responsibilities of "the Actuary and/or Statistician" in *" The Industrial Conciliation and Arbitration Act of 1929" (by this Act conferred, imposed, and vested in the Bureau, or Director or delegated or authorised officer as aforesaid), the Bureau is hereby empowered and authorised to hold any inquiry that may be necessary into any of the matters hereinbefore mentioned and in particular as to- (a) The income and productivity of Queensland year by year, and the estimated production of any year; ~ b) The probable economic effects of any existing regulation of labour conditions, and of any variation in those conditions, whether of wages, hours, or other matters, including the probable economic effects upon anyone industry or occupation, or group of industries; (c) The relations between real wages and pro- ductivity, and any methods whereby it may be practicable to adjust wages to productivity; and (d) Such other matters of an economic nature as, in the opinion of the Bureau or of the Court, may be of assistance to the Court. (4.) Moreover, for the purposes of sections nine, twenty-eight, sixty-two, and rule two of the Second Schedule of *" The Industrial Conciliation and Arbitration * 20 Geo. V. Act of 1929," the term" Bureau .of Statistics" referred to in the said sections and rule shall mean the Bureau of Economics and Statistics constituted under this Act. 13141 PART II.- ESTABLISH- MENT OF BUREAU OF ECONOMICS AND STATISTICS. (5.) It shall also be the duty of the Bureau, as far as may be practicable, to promote effective measures to combat unemployment, and to encourage improved relations between employers and employees, whether by assisting in the establishment and conduct of voluntary co-operative activities such as joint committees, industrial councils, co-partnership schemes, or by any other means; the object being to promote the general welfare of the community. (6.) It shall be the duty of the Bureau to conduct any inquiry or investigation of an economic nature referred to it by the Governor in Council and to make a report thereon to the Governor in Comtcil accordingly. (7.) The Bureau shall also be available to advise the Minister on matters connected with this Act generally. (8.) The Bureau with the approval of the Governor in Council may make rules to give effect to its powers and duties under this Act. 9. (1.) For the purposes of carrying out the objects Power?f and purposes of this Act, and its powers, duties, and delegatIOn. responsibilities thereunder, the Bureau is hereby autho- rised to delegate to any person the conduct of any inquiry or investigation and may require such person to submit the evidence taken thereat, together with a report thereon, to the Bureau. (2.) For the purposes of this Act, the Bureau, or Bureau and the Director or delegated or authorised officer, or any ~ ~ 7egated person to whom the Bureau has delegated the conduct or authorised of any inquiry or investigation, shall be deemed to be berson to a Commission within the meaning of *" The o.[fic£al C~ ! mission. Inqu£1'ies Evidence Acts, 1910 to 1929," and all the powers, authorities, and protection afforded by that Act shall apply and extend to the Bureau, or the Director or delegated or authorised officer, or to any person to whom the Bureau has delegated the conduct of any inquiry or investigation, as aforesaid. ,. 1 Geo. 13142 PART III.- COLLECTION OF STATISTICS. STATISTICS. Bureau of Economics and Statistics Act. 21 GEO. V. No. 15, PART IlL-COLLEctION OF STATISTICS. Collection of 10. (1.) Subject to this Act, the Bureau, by its statistics. Secretary or other authorised officer, shall from time to time prepare and issue forms and instructions and take all necessary steps for the collection of such statistics and statistical or other information (referred to as " statistics") as may from time to time be required for the purposes of this Act or *" The Industrial and Concilia- tion and Arbitration Act of 1929." (2.) For the purpose of collecting any statistics for purposes of this Act or *" The Industn:al ConciUation and Arbitration Act of 1929," the Bureau, by its Secretary or other authorised officer, may prepare and make available to such persons who may be required to furnish statistics, by delivery or in such manner as it thinks fit or as may be prescribed, any forms prescribed for procuring such statistics, in order that such forms may be filled up by such persons and returned to him. (3.) Such forms shall specify the nature of the statistics required by the Bureau. (4.) Every person to whom any such form is so made available shall insert or cause to be inserted therein the full information required thereby to the best of his knowledge and belief, and shall, within thirty days or such time as may be prescribed after the making available bv the Bureau of such form to him, return the same, d;Jly filled up, to the Secretary or to some person authorised by the Bureau to collect or receive the same. Income tax 11. For the purposes of facilitating administration returns, and to minimise the requirement of the furnishing by any person of returns under this Act or the furnishing of returns of like nature or similar in form and substance to forms furnished by any person under the Income Tax Acts, it is hereby declared that the Director, if he considers it necessary .or desirable for the purposes of any inquiry or investigation or other matter or thing under this Act so to do, may, notwithstanding anything in t" The Income Tax Act of 1924" to the contrary, have made available to him by the Commissioner of Taxes under this Act such information as will facilitate and minimise the furnishing of returns.. * 20 Geo V. In any such case the returns furnished to the Commissioner under the Income Tax Acts shall be accepted under the circumstances as hereinbefore set forth as returns under this Act. Moreover, the Director or officer authorised by him or any other officer of the Bureau shall preserve and aid in preserving secrecy with regard to any matter that may come to his knowledge in his official capacity in accordance with the provisions herein contained, and shall not communicate any such matter to any other person except in the performance of his duties under this Act: Provided that, in the publication of any statistics pursuant to information received from such income tax returns, no matter of a private or confidential nature in relation to any person shall be disclosed, nor shall any publication be made as would divulge the contents of any particular return. , 12. If any of the returns required under this Act Bureau may are not made, or are not collected, or do not reach the ~ : { ~ r~ ~ . fres!( hands of the Bureau, or are so imperfect as to be valueless or misleading, the Bureau may direct that such returns be made or collected anew. 13. Secretary, or any person authorised in writing by the Director, may at any time during working hours enter any land, factory, mine, workshop, or place where persons are employed, and may inspect the same or any part of it and all plant and machinery used in connection with it, and may make such inquiries as are prescribed or authorised bv this Act. 14. When and so often as the Registrar-General Dutr of (who for the purposes of this Act is deemed to be an ~ : :: ' ~l~ r. authorised officer of the Bureau) is required to furnish particulars with respect to any matters that may be required by the Bureau, it shall be the duty of the Registrar-General forthwith to ascertain such facts and collect such information as will enable him to compile and furnish the particulars required, and for that purpose he may require returns to be furnished to him by any person or information to be given to him orally by any

Information 15. Every person shall to the best of his knowledge tsoupbpelied. and belief answer all questions asked him by the Bureau or by its duly authorised officers necessary to obtain any information required for the purpose of any statistics authorised by this Act to be collected, and on request shall furnish any information (written or oral) required for the purposes of this Act. Publication of statistics. 16. The Bureau shall compile and tabulate the statistics collected pursuant to this Act, and shall, as may be prescribed, publish such statistics or abstracts thereof with observations thereon, and where necessary for the proper carrying out of its duties and responsibilities make any such statistics available to the Court under and subject to the provisions of t" The Industrial Conciliation and Arbitration Act of 1929 "': Exception as Provided that in the publication of any statistics ctoon p f r i I d v e a n t t ~ Iaol r under and for the purposes of this C Act no matter of a matters. private or confidential nature in relation to any person shall be disclosed. Failure to furnish information. 17. Any person who-- (a) Refuses or wilfully neglects to fill or cause to be filled up a form prescribed or made avail- able to him under this Act; (b) Inserts or permits to be inserted in such form any information known by him to be false; (c) Refuses or wilfully neglects, within the time prescribed, to return the form duly fil1ed up to the Bureau or the Secretary, or to any person authorised by the Director to collect or receive the same; (d) Hinders or obstructs the Bureau or the Secretary, or any person acting under the authority of the Bureau or the Director, in the execution of any power or duty conferred or imposed by this Act; shall be liable to a penalty not exceeding tweni)y pounds. * 1 Geo. COLLECTION OF STATl~ TJCS, Upon the conviction of any person for any offence against this section, the Court shall order such person to furnish such form with the required information contained therein as may be required by this Act within a time specified in such order, and any person who fails or neglects to duly comply with such order shall be guilty of an offence, and shall be liable to a penalty of not less than five pounds nor more than fifty pounds. 18. Any person employed in collecting or compiling Collectors statistics under this Act who divulges, makes extracts ~i; Ulgint from, or publishes any information obtained under this III ormalon. Act, except under the authority of the Bureau, shall be liable to a penalty' not exceeding fifty pounds. 19. (1.) Any person who is guilty of any breach of General or contravention of this Act shall, if no other penalty is penalty. prescribed, be liable to a penalty not exceeding ten pounds. (2.) All offences against this Act shall be heard and Recov~ ry of determined, and all penalties (including any costs and penaltIes. expenses ordered by the Court to be paid to the Bureau pursuant to this Act), shall be recovered in a summary way by complaint under *" The Justices Acts, 1886 to 1929." (3.) Any member of the Police Force or the Institution Secretary, or any other person authorised under the ~ ! oceedingl! l. hand of the Director, may institute proceedings under this Act. Any person who lays any complaint for an offence against this Act shall in the absence of evidence to the contrary be deemed to have been authorised under this Act to lay such complaint. The production of a telegram purporting to have been received from the Secretary of the Bureau, and purporting to authorise any person to institute any prosecution for an offence under this Act or any proceed- ings, shall be admissi.ble as evidence on the prosecution or proceedings, and shall be accepted as evidence of the authority of the officer to institute the prosecution or proceedings. All proceedings for such offences may be commenced at any time within ninety days after the fact of the commission of such offence came to the knowledge of the complainant or the Bureau. *50 Vic. For the purposes of this Act a form shall be deemed to have been lawfully delivered when- (a) Served directly upon the person to whom it is addressed by any person authorised by the Bureau or Secretary; or (b) Left at or forwarded by post to the usual or last known place of abode of such person. (2.) In any prosecution under this Act-- (i.) It shall be incumbent upon any person charged with refusing or wilfully neglecting to return a form prescribed or delivered to him as aforesaid to prove that he, within the prescribed time- (a) Delivered such form duly filled up as prescribed to the Secretary or to some person authorised by the Bureau to collect or receive the same; or (b) Deposited or caused to be deposited in some post office such form addressed to the Secretary or authorised person; (ii.) The production of a certificate under the hand of the Secretary or authorised officer- (a) Stating the date and contents of any letter addressed to the defendant, and the date upon which it was lawfully delivered, shall be prima facie evidence of the contents of such letter and the delivery thereof to the defendant; (b) Stating that any notice, form, or other document was duly made available or delivered to the defendant, shall be prima facie evidence of the making available or delivery thereof to the defendant. (iii.) Any certificate, notice, or other document bearing the written, stamped, or printed signature of the Director or Secretary shall, until the contrary is proved, be deemed to have been duly signed by the Director or Secretary. Judicial notice shall be taken of every such signature and of the fact that the person whose signature it purports to be holds or has held the office of Director or Secretary.

The production of the Gazette containing any notice purporting to be published by the Secretary or any form prescribed under this Act shall be conclusive evidence of such notice, form, or publication and of the cont ent s there. -o f . PART IV.- AMENDMENT OF STATISTIGAL PART IV.-AMENDMENT OF STATISTICAL RETURNS ACT. RETURNS ACT. 21. (1.) Section four of *" The Statistical Returns Amenrli?ent Act of 1896" is repealed and a new section is inserted ~ O~ ~ : ' l~ : 4. in lieu thereof, namely:- " [4. AMENDMENT OF STATISTICAL RETURNS deemed to be returns also for the purposes of this Act, ACT. and the Registrar-General and officers of the Department of the Registrar-General shall be and be deemed authorised officers under and for the purposes of this Act and the Bureau so established. PART V.-MISOELLANEOUS. PARTV.- MISCEL- LANEOUS. 22. (1.) The Governor in Council may from time Regulations. to time make such regulatjons providing for all or any purposes, whether general or to meet particular cases, as may be convenient for the administration of this Act, or as may be necessary or expedient to carry out the objects and purposes of this Act. Without limiting the generality of the foregoing provisions, such regulations may provide for all or any of the following matters : - (a) Prescribing forms of returns and of statistics to Returns, &0. be made and furnished to the Bureau, and the contents thereof, and the persons by whom the same shall be made, and the time and mode of making and furnishing the same; (b) Provisions relating to secrecy, in respect of trade secrets, or the financial position of any person, or the contents of any books or documents produced before the Bureau, or other provisions as to secrecy as may be prescribed; (c) All matters requked or permitted by this Act General. to be prescribed; (d) Generally to give effect to the objects and purposes of this Act. (2.) The regulations may fix a penalty, not exceeding in any case twenty pounds, for any breach thereof. (3.) All such regulations made or purporting to have been made under this Act, upon being published in the Gazette, shall have the same force and effect as if t.hey were enacted in this Act, and shall be judicially noticed, and their validity shall not be questioned in any proceedings whatever. (4.) Such regulations shall be laid before the Legislative Assembly within fourteen days after such

No. 35, publication if Parliament is in session, or, if not, then within fourteen days after the commencement of the next session. If the Legislative Assembly passes a resolution disallowing any such regulation, of which resolution notice has been given at any time within fourteen sitting days after such regulation has been laid before it, such regulation shall thereupon cease to have effect, but without prejudice to the validity of anything done in the meantime. Annual report. 23. As soon as may be after the thirtieth day of June in each year the Director' shall submit to Parliament a report of the work of the Bureau during the financial year just closed.
