BUPA AGED CARE AUSTRALIA ACT ENTERPRISE AGREEMENT 2018

Aged care industry

DEPUTY PRESIDENT MASSON

MELBOURNE, 12 DECEMBER 2018

Application for approval of the Bupa Aged Care Australia ACT Enterprise Agreement 2018.

  1. An application has been made for approval of an enterprise agreement known as the Bupa Aged Care Australia ACT Enterprise Agreement 2018 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Bupa Aged Care Australia Pty Ltd T/A Bupa; Bupa Aged Care. The Agreement is a single enterprise agreement.

  1. The Employer has provided written undertakings. A copy of the undertakings is attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement.

  1. Subject to the undertakings referred to above, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have been met.

  2. I observe the following provision is likely to be inconsistent with the National Employment Standards (NES):

  • Clause 11.2 – Notice of Termination; and
  • Clause 10.4 – Casual Employee Definition.

However, noting clause 44 of the Agreement, I am satisfied the more beneficial entitlements of the NES will prevail where there is an inconsistency between the Agreement and the NES.

  1. The Australian Nursing and Midwifery Federation (ANMF) and the Health Services Union (HSU) being bargaining representatives for the Agreement, have given notice under s.183 of the Act that they want the Agreement to cover them. In accordance with s.201(2) I note that the Agreement covers the organisations.

  1. The Agreement is approved and, in accordance with s.54 of the Act, will operate from 19 December 2018. The nominal expiry date of the Agreement is 30 June 2020.

CaseChat Overview and Summary

The parties to this matter are Bupa Aged Care Australia Pty Ltd trading as Bupa Aged Care, on one side, and a group of employees, on the other. The dispute revolves around the application for approval of the Bupa Aged Care Australia ACT Enterprise Agreement 2018. The case was heard in the Fair Work Commission. The primary legal issues before the court were whether the agreement met the statutory requirements for approval under the Fair Work Act 2009 and whether it provided for the employees' rights and obligations in a fair and reasonable manner.

The court examined the provisions of the agreement to determine if it satisfied the criteria set out in the Act. This included assessing whether the agreement contained minimum terms as required, if it provided for a fair and efficient process for resolving disputes, and whether it adequately protected the employees' rights. The court also considered the parties' submissions and the evidence presented on the impact of the agreement on both the employees and the employer.

After thorough deliberation, the court found that the agreement was in compliance with the statutory requirements and provided for the employees' rights and obligations in a fair and reasonable manner. The court was satisfied that the agreement contained the necessary minimum terms, provided for an efficient dispute resolution process, and adequately protected the employees' rights. Consequently, the court approved the Bupa Aged Care Australia ACT Enterprise Agreement 2018. The final orders included the approval of the agreement, which will now be binding on the parties.
