The Australian Capital Territory Executive makes the following Regulations under the Buildings (Design and Siting) Act 1964.

Commencement

1.  These Regulations commence on the day on which they are notified in the Gazette.

Exemption from notification and review requirements

2. Regulation 9 of the Buildings (Design and Siting) Regulations is amended—

(a)by inserting after subregulation (2) the following subregulation:

“(2A)  Sections 229 and 276 of the applied Part do not apply in relation to an application for approval of the external design and siting of a garage or carport where the applicant gives the Authority a statement in writing signed by the lessee of each adjoining property to the effect that the lessee is aware of the application and has no objection to the garage or carport being built on the site specified in the application.”; and

(b)by inserting in subregulation (3) the following definitions:

“ ‘carport’ has the same meaning as in Appendix VI to the Plan;

‘garage’ has the same meaning as in Appendix VI to the Plan;”.
