Building Services (Registration) Act 2011

Building Services (Registration) Amendment

Regulations 2017

Made by the Governor in Executive Council.

1.            Citation

These regulations are the Building Services (Registration)
Amendment Regulations 2017.

2.            Commencement

These regulations come into operation as follows —

(a)	regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations — on the day after that day.

3.            Regulations amended

out all or part of the builder work; or

These regulations amend the Building Services (Registration) Regulations 2011.
4.	Regulation 3 amended In regulation 3 insert in alphabetical order:

owner-builder, in relation to building work, means a
person who has an owner-builder approval granted
under the Building Services (Registration) Act 2011
section 45 to carry out the building work;
principal builder, in relation to builder work, means a
person who carries out, or undertakes to carry out, the

builder work for another person but does not include —

(a) a person engaged as a subcontractor to carry

(b) a person who carries Out, or undertakes to carry

Out, all or part of the builder work for an owner-builder;

5. Regulation 4 amended
Delete regulation 4(a) and insert:

(a) builder work as a principal builder;

6.            Regulation 5 amended

In regulation 5 delete "builder work as the person named as the builder on a building permit" and insert:

builder work as a principal builder

7.            Regulation 13 amended

Delete regulation 13(2) and insert:

(2) If a person carries out, or undertakes to carry Out,
building work for another person under more than
1 distinct contract or engagement and the building
work is substantially a single undertaking in connection
with a single building, the value of all the work must
be added together for the purposes of calculating the
value of the building work.

8.             Regulation 15 amended

In regulation 15 delete "builder work as the person named as the

builder on a building permit" and insert:

builder work as a principal builder

9.             Regulation 21 amended

In regulation 21 delete "builder work as the person named as the builder on a building permit" and insert:

builder work as a principal builder
