(Refund of fees)

HIS Excellency the Governor, with the advice of the Executive Council and in pursuance of the Building Services Corporation Act 1989, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 21 March 1990.
Amendment
2. The Building Services Corporation Regulation 1990 is amended
by inserting after clause 26 the following clause:
Refund of fees
26A. (1) The Corporation may refund the whole or any part of
the relevant fee if;
(a) an application for an authority or permit, or for the renewal or restoration of an authority or permit, is refused
or withdrawn; or(b) an authority is surrendered; or
(c)
an application to sit for an examination conducted by or on behalf of the Corporation or for the re-mark of the result

of such an examination is refused or withdrawn or an
applicant does not attend for such an examination.
(2) Any such refund is to be paid to:
(a)
the applicant for or the holder of the authority or permit; or
(b) the applicant for the examination or the re-mark; or
(c)
any other person who appears to the Corporation to be entitled to the refund.
EXPLANATORY NOTE
The object of this Regulation is to amend the Building Services Corporation Regulation 1990 to provide for the refund of application or examination fees in certain specified circumstances.
