BUILDING SERVICES CORPORATION ACT 1989—

REGULATION

(Relating to exemptions to the doing of specialist work, the recording of

complaints and application fees)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Building Services Corporation Act 1989, has been pleased to make the Regulation set forth hereunder.

Commencement

1. (1) Clause 2 (a)–(c) and (e) commences on 1 March 1993.

(2) Clause 2 (d) commences on 1 June 1993.

Amendments

2. The Building Services Corporation Regulation 1990 is amended:

(a) by inserting in clause 13 (2) after the words “section 12 (unlicensed work)” the words “and section 14 (unqualified electrical work)”;
(b) by omitting from clause 26 (2) (b) the words “, renewal or

restoration”;

(c)

by inserting at the end of clause 26 (2) (c) the following word and paragraph:

; or

(d) for the renewal or restoration of a supervisor certificate.

(d) by inserting at the end of clause 40 (a) (xi) the following subparagraph:

(xii)  the number of complaints made to the Corporation about the holder, other than those arising out of matters which have been resolved or rectified to the satisfaction of the Corporation.

(e)

by omitting Schedule 2 and by inserting instead the following Schedule:

* “Building contractor” and “building supervisor” include a contractor

or supervisor for swimming pools, garages, carports, screened

enclosures, structural landscaping, kitchen renovations, bathroom

renovations and laundry renovations.

EXPLANATORY NOTE

The object of this Regulation is to amend the Building Services Corporation

Regulation 1990 so as:

to provide that an individual who does electrical work is exempt from the requirements of section 14 of the Building Services Corporation Act 1989 relating to unqualified electrical work if the individual is employed by an electrical supply authority principally for the performance of work other than electrical work but the electrical work is done in the ordinary course of the employee’s duties

to require particulars of the number of complaints against licence holders (other than those which have been resolved or rectified to the satisfaction of the Building Services Corporation) to be included in the register maintained by the Corporation

to remove the application fees for the renewal and restoration of a supervisor certificate (Schedule 2 has been substituted but no application fees have been increased).

This Regulation is made under the Building Services Corporation Act 1989, including section 140 (the general regulation-making power) (in particular, section 140 (2) (a), (i) and (k)) and section 120.
