Building Act 1993

Building (Qualifications) Regulations 1996

The Governor in Council makes the following Regulations:

1. Objective

The objective of these Regulations is to amend the

Building Regulations 1994—

(a)

to provide for standards of professional conduct for building practitioners; and

(b)

to provide for qualifications and other matters relating to the registration of building practitioners; and

(c)

in relation to the registration of domestic builders; and

(d)

as a result of changes to the Building Act 1993 and the House Contracts Guarantee Act 1987.

2. Commencement

These Regulations come into operation on 1 May
1996.

3. Authorising provisions

These Regulations are made under sections 170, 261 and 262 and Schedule 2 of the Building Act 1993.

4. Principal Regulations

In these Regulations the Building Regulations

19941 are called the Principal Regulations.

5. Requests for information

For regulations 2.10(2) and 2.10(3) of the
Principal Regulations substitute—

"(2) An owner or mortgagee of a building or land

or a prescribed building practitioner under
section 137B of the Act may request the
relevant council to provide inspection
approval dates of the mandatory notification
stages for building work carried out on that
building or land.

(3) A recognised person within the meaning of the House Contracts Guarantee Act 1987 may request the relevant council to provide inspection approval dates of the mandatory notification stages for building work to

which a guarantee under that Act applies.".

6. Revocation of Part 13

Part 13 of the Principal Regulations is revoked.

7. New Part 15 substituted

For Part 15 of the Principal Regulations substitute—

"PART 15—BUILDING PRACTITIONERS

15.1 Interpretation

In this Part—
Building (Qualifications) Regulations 1996

"Board" means the Building

Practitioners Board.

15.2 Professional standards

A registered building practitioner

must2—

(a)

building practitioner in a

(1) For the purposes of registration under section 170 of the Act, the prescribed qualifications for registration of the

following categories and prescribed
classes of building practitioner are as

(a) Category of building surveyor—

(i)

a degree or diploma in university within the

(ii) 4 years of practical
experience to the satisfaction
of the Board;

(b) Category of building inspector—

(i) an associate diploma of
applied science (building
inspection) from a course
accredited under the
Vocational Education and
Training Act 1990; and
(ii) 3 years of practical
experience to the satisfaction
of the Board;

(c) Category of quantity surveyor—

(i)

quantity surveying from a
university within the

a degree or diploma in Education Act 1993; and

(ii) 2 years of practical
experience to the satisfaction
of the Board;

(d)

Category of engineer, class of civil engineer—

(i) the following
qualifications—
(A) a degree in civil

engineering from a
university within the
meaning of the
Tertiary Education
Act 1993; and

(B) 3 years of practical

experience to the satisfaction of the Board; or

(ii) a current certificate of
registration as a civil
engineer on the National
Professional Engineers
Register—Section Three
(NPER-3);

(e)

Category of engineer, class of mechanical engineer—

(i) the following
qualifications—
(A) a degree in mechanical

engineering from a
university within the
meaning of the
Tertiary Education

Act 1993; and

(B) 3 years of practical

experience to the satisfaction of the Board; or

(ii) a current certificate of
registration as a mechanical
engineer on the National
Professional Engineers
Register—Section Three
(NPER-3);

(f)

Category of engineer, class of electrical engineer—

(i) the following
qualifications—

Category of draftsperson, class of building design (architectural)—

(i) an associate diploma of
architectural drafting from a
course accredited under the
Vocational Education and
Training Act 1990; and
(ii) 1 year of practical
experience to the satisfaction
of the Board;

(h)

Category of draftsperson, class of building design (interior)—

(i) an associate diploma of
arts—interior design from a
course accredited under the
Vocational Education and
Training Act 1990; and

(ii) 1 year of practical
experience to the satisfaction
of the Board;

(i)  Category of draftsperson, class of building design (services)—

(i) one of the following
qualifications—
(A) an associate diploma of

engineering drafting—
civil, electrical or

mechanical; or

(B) a certificate IV,

diploma or advanced
diploma in fire
technology from a
course accredited under
the Vocational
Education and
Training Act 1990;

and

(ii) 1 year of practical
experience to the satisfaction
of the Board;

(j)

Category of builder, class of commercial builder (structural)—

(i) the following
qualifications—
(A) a degree, diploma or

associate diploma of
building from a
university or TAFE
College within the
meaning of the
Tertiary Education
Act 1993; and

adequate knowledge and

certifying that the applicant has
adequate knowledge and
experience (including financial
management knowledge and
experience) to manage or arrange
the carrying out by a builder
registered under the Act in another
class of domestic builder of the

after examination of the applicant,

(i)  an intermediate scaffolding certificate issued under the Occupational Health and

Safety (Certification of Plant
Users and Operators)
Regulations 1994; and
(ii) 1 year of practical
experience to the satisfaction
of the Board;
(s) Category of erector or supervisor (temporary structures), class 2— special structures—tents,

marquees—

(i)

the applicant, certifying that
the applicant has adequate
knowledge and experience to
erect or dismantle or
supervise the erection or the

(2) For the purposes of sub-regulation (1)

cladding, swimming pools, spas

and the like;

(b)

the provision of lighting, heating, electrical services;

(c)

site work involved in relocating an existing home;

(d) door or window installation,
sub-floor work, roofing, fencing,
bathroom and kitchen renovations
and the like.

(3) For the purposes of sub-regulation (1)

"special buildings" means—

(a)

buildings of composite, precast or tilt-up panel construction; or

(b) buildings incorporating
prestressed concrete elements; or
(c) stressed skin structures, chimneys,
towers, masts or any similar
structures.

15.4 Transitional

(1) A building practitioner who

immediately before the commencement
of the Building (Qualifications)
Regulations 1996 was registered under
Part 11 of the Act as a building
surveyor, Class of municipal building
surveyor or Class of private building
surveyor is deemed on that
commencement to be registered under
that Part as a building surveyor.

(2) A building practitioner who

immediately before the commencement
of the Building (Qualifications)
Regulations 1996 was registered under
Part 11 of the Act as a building
inspector, Class of municipal building
inspector or Class of private building
inspector is deemed on that
commencement to be registered under

that Part as a building inspector.

(3) A building practitioner who

immediately before the commencement Part 11 of the Act as a draftsperson may within 3 months after the date of the next anniversary of his or her registration after that commencement apply to the Board for registration as a draftsperson in a class or classes specified in regulation 15.3 (1).

was registered under Part 11 of the Act as a builder, Class 1— Construction; and

(b)

was required to comply with the Order made under section 135 of the Act on 2 March 1995 and

published in the Government

Gazette on 9 March 1995—

that practitioner is deemed on that
commencement to be registered under
that Part as a builder, class of

commercial builder (structural).

(6) If, immediately before the

commencement of the Building
(Qualifications) Regulations 1996, a

building practitioner—

(a)

was registered under Part 11 of the Act as a builder, Class 1— Construction; and

(b)

was not required to comply with the Order made under section 135 of the Act on 2 March 1995 and published in the Government Gazette on 9 March 1995—

that practitioner is deemed on that

commencement to be registered under
that Part as a builder, class of

commercial builder (non structural).

(7) A building practitioner who

commencement to be registered under
that Part as an erector or supervisor
(temporary structures), class 1—stages
or seating stands, or equipment
platforms or towers fabricated on site
from tubes and fittings or other
scaffolding components of metal or

other materials.

(10) A building practitioner who

immediately before the commencement
of the Building (Qualifications)
Regulations 1996 was registered under
Part 11 of the Act as a supervisor
(temporary structures), Class 2—
Special structures—tents, marquees,
safety barriers, is deemed on that
commencement to be registered under
that Part as an erector or supervisor
(temporary structures), class 2—special
structures—tents, marquees.

15.5 Exemption for certain building

practitioners

(1) A builder who is solely engaged in the

business of carrying out domestic
building work is not required to be
registered as a building practitioner
under Part 11 of the Act if the value of
the domestic building work carried out
by that person is $5000 or less in each
case.

(2) A builder (not being a builder to whom

sub-regulation (1) applies) who is solely engaged in the business of carrying out, managing, or arranging

the carrying out of the construction of registered as a building practitioner under Part 11 of the Act until 1 November 1996.

(3) A draftsperson who is solely engaged in

the business of preparing plans for
domestic building work or
documentation relating to permits or
permit applications for domestic
building work is not required to be
registered as a building practitioner
under Part 11 of the Act if the value of
the domestic building work is $5000 or
less in each case.

(4) An applicant for registration as a

building practitioner in the category of
draftsperson, class of building design
(architectural), is exempt from the
requirements of section 170(1)(b)(i) of
the Act if the applicant—

(a)

architectural drafting and

has a certificate of proficiency in by—

(i) the Professional Drafting and
Design Group; or

(ii)  the Building Designers Association of Victoria Incorporated; or

(iii) the Master Builders
Association of Victoria; or
(iv) the Housing Industry
Association Building Design
and Drafting Council and;
(b) has 5 years of practical experience to the satisfaction of the Board; and
(c)

lodges the application with the 2000.

(5) An applicant for registration as a

building practitioner in the category of
draftsperson, class of building design
(interior) is exempt from the


requirements of section 170(1)(b)(i) of

the Act if the applicant—

(a)

design drafting and documentation

has a certificate of proficiency in Australia; and

(b)

has 5 years of practical experience to the satisfaction of the Board; and

(c)

lodges the application with the 2000.

(6) An applicant for registration as a

building practitioner in the category of
draftsperson, class of building design
(services) is exempt from the
requirements of section 170(1)(b)(i) of

the Act if the applicant—

(a)

mechanical services, plumbing

has a certificate of proficiency in and documentation issued by—

(i) the Master Plumbers and
Mechanical Services
Association of Australia; or
(ii) the National Association of
Plumbing Consultants
Incorporated; or
(iii) the Australian Fire Safety
Practitioners Accreditation
Board Inc.; and
(b) has 5 years of practical experience to the satisfaction of the Board; and
(c)

lodges the application with the 2000.

(7) A draftsperson who is solely engaged in

the business of preparing civil,
mechanical, or electrical plans or other
documentation relating to permits or
permit applications for building
practitioners in the category of
engineer, is not required to be

registered as a building practitioner
under Part 11 of the Act.

(8) An applicant for registration as a

building practitioner in the category of
builder, class of commercial builder
(structural) is exempt from the
requirements of section 170(1)(b)(i) of

the Act—

(a) if the applicant—

(i) was immediately before 5
May 1995—
(A) an associate member or

corporate member of
the Australian Institute
of Building; or

(B) a member of the Master Builders Association of Victoria in the general

contractor group; or (C) a member of the

Housing Industry
Association Limited
in the
commercial/industrial

group; and

(ii)

lodges the application with May 1997; or

(b) if the applicant—

(i)

has 10 years of practical of the Board; and

(ii)

lodges the application with May 1997.

(9) An applicant for registration as a

building practitioner in the category of
builder, class of domestic builder
(unlimited), is exempt from the
requirements of section 170(1)(b)(i) of
the Act if, immediately before the
commencement of the Building
(Qualifications) Regulations 1996, that

applicant—

(a)

guarantor under section 23 of the
House Contracts Guarantee Act
1987 in the class of general
builder or general supervisor, and
was the person nominated to the
approved guarantor as the person

was approved by the approved applicant; or

(b) was the person nominated to the approved guarantor as the person in charge of construction by a

partnership or company approved by the approved guarantor under section 23 of the House

Contracts Guarantee Act 1987 in the class of general builder or general supervisor.

(10) An applicant for registration as a

building practitioner in the category of
builder, class of domestic builder
(limited), is exempt from the
requirements of section 170(1)(b)(i) of
the Act if, immediately before the
commencement of the Building

1987 in the class of restricted
builder or restricted supervisor
and was the person nominated to
the approved guarantor as the

(11) An applicant for registration as a

building practitioner in the category of
builder, class of domestic builder
(manager) is exempt from the
requirements of section 170(1)(b)(i) of

the Act if the applicant—

(a) was immediately before the
commencement of the Building
(Qualifications) Regulations
1996—
(i)

member of a partnership
approved by the approved
guarantor under section 23 of

a director of a company or a Guarantee Act 1987 and is

still a director of that
company or a member of that
partnership at the time of
making the application; or

(ii)  a person approved by the approved guarantor under section 23 of the House

Contracts Guarantee Act
1987, but was not the person
nominated to the approved
guarantor as the person in
charge of construction by the
applicant; and

(b)

lodges the application with the Board on or before 1 May 1998.

15.6 Period for which private building surveyor

may not act

The prescribed period for the purposes of section 79 of the Act is 1 year.

15.7 Certificates of compliance

(1) The prescribed categories of

practitioners for the purpose of section

238 of the Act are as follows—

(a)

structural, sewerage, water or

for a certificate relating to a engineer, class of civil engineer;

(b)

for a certificate relating to a mechanical matter including hydraulic services within a

building—category of engineer,
class of mechanical engineer;

(c)

for a certificate relating to an electrical matter—category of

engineer;

(d)

erection of a prescribed temporary
structure—category of erector or

(2) A certificate under section 238 of the Act must be—

(a) in accordance with Form 13 in relation to the design or part design of a building; and
(b)

in accordance with Form 14 in building work.

15.8 Duplicate certificates

For the purposes of section 172(7) of the Act, the prescribed fee for a

Note 4 If an owner builder, restrictions on sale of the
property apply under section 137B of the Act. Section 137B
also prohibits an owner builder of domestic building work
from selling the building within 6½ years from the date of
completion of the relevant works unless they have satisfied
certain requirements including obtaining compulsory
insurance. The Building Control Commission maintains a

current list of domestic building insurance providers.

Act, a building permit levy is required to be paid to the

which in association constitute—

may be the subject of an inquiry under section 179 of the Act.

qualifications and experience to those listed in this regulation.
