  1. Name of regulation

    This regulation is the Building (General) Amendment Regulation 2012 (No 2).

  2. Commencement

    This regulation commences on the day after its notification day.

    NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

  3. Legislation amended

    This regulation amends the Building (General)Regulation 2008.

44AAEnergy efficiency provisions—Act, s 139C (3)

(1)The following provisions are prescribed:

(a)for a class 1 and associated class 10a building—

(i)the building code, volume 2, part 3.12.0.1 (Heating and cooling loads); and

(ii)the relevant energy efficiency provisions of the ACT appendix to the building code;

(b)for a class 2 building or a class 4 part—the building code, volume 1, part JO.2 (a) (Heating and cooling loads of sole‑occupancy units of a class 2 building or class 4 part).

(2)In this section:

ACT appendix to the building code means the Australian Capital Territory Appendix to the Building Code of Australia made under the Act, section 136 (2) as in force from time to time.

house energy rating software means computer software used to assess thermal efficiency that is—

(a)accredited under the nationwide house energy rating scheme; or

(b)determined by the construction occupations registrar under the Construction Occupations (Licensing) Regulation 2004, section 31A (2) (b).

relevant energy efficiency provision means a provision that allows compliance with energy efficiency performance requirements for space heating and cooling loads by the use of house energy rating software.
