Building Further Amendment (New Residential Zones) Regulations 2014
The Lieutenant-Governor as the Governor's deputy with the advice of the Executive Council makes the following Regulations:

1Objective
The objective of these Regulations is to further amend the Building Regulations 2006—
(a)to update the zones in planning schemes that specify siting requirements which override siting requirements in those Regulations; and
(b)to make other miscellaneous amendments.
2Authorising provisions
These Regulations are made under sections 7, 9, 261 and 262 of, and Schedule 1 to, the Building Act 1993.
3Principal Regulations
In these Regulations, the Building Regulations 2006[1] are called the Principal Regulations.
4Building height
For regulation 410(1) of the Principal Regulations substitute—
"(1)If—
(a)an allotment is in a zone of a planning scheme specified in Schedule 5; and
(b)that zone, or a Schedule to that zone, specifies a maximum height for buildings—
the height of a building on that allotment must not exceed the relevant height specified in that zone or Schedule (as the case may be).".
5Fences on or within 150mm of side or rear boundaries
In regulation 426(1) of the Principal Regulations, for "regulation 415(2)," substitute "either regulation 415(2) or (3) (as the case requires),".
6Amendment of Schedule 5—Planning schemes
In Schedule 5 to the Principal Regulations—
(a)before item 1 insert—
| "1AA | Banyule Planning Scheme | General Residential Zone (GRZ) Neighbourhood Residential Zone (NRZ)"; |
(b)after item 11 insert—
| "11A | Melton Planning Scheme | Neighbourhood Residential Zone (NRZ)"; |
(c)after item 12 insert—
| "12A | Nillumbik Planning Scheme | Neighbourhood Residential Zone (NRZ)". |
