s1 2 s5 Building Fire Safety Amendment Regulation (No. 1) No. 151, 2002 2002 1 Short title This regulation may be cited as the Building Fire Safety Amendment Regulation (No. 1) 2002 . 2 Commencement This regulation commences on 1 July 2002. 3 Regulation amended This regulation amends the Building Fire Safety Regulation 1991. 4 Amendment of s 4 (Definitions) (1) Section 4, definition “Australian Standard”— omit . (2) Section 4, definition “Fire Service Act”, ‘ Authority ’— omit, insert— Service ’. 5 Amendment of s 10 (Limitation of the number of persons using a building) (1) Section 10(1)(b), from ‘in compliance’ to ‘Australia.’— omit, insert ‘under—
s6 3 s6 Building Fire Safety Amendment Regulation (No. 1) No. 151, 2002 2002 (i) for a budget accommodation building to which the BuildingAct1975 , part 2A, division 3 1 applies—part 14, items P3 and A3 of the Queensland Development Code; or (ii) otherwise—clause D 1.13 of the BuildingCode of Australia.’. (2) Section 10— insert (5) In this section— “Queensland Development Code” see the Standard Building Regulation1993 , section 5. 2 ’. 6 Insertion of new s 13A After section 13— insert ‘13A Evacuation training for budget accommodation buildings (1) The occupier of a budget accommodation building must ensure an evacuation of the building under the fire and evacuation plan for the building is carried out at intervals of not more than 12 months. Maximum penalty—10 penalty units. 1 See the BuildingAct1975 , part 2A (Fire safety for budget accommodation buildings), division 3 (Budget accommodation buildings built, approved or applied for, before 1 January 1992), section 12G (Application of div 3)— 12G Application of div 3 This division applies to a budget accommodation building only if— (a) construction of the building started before 1 January 1992; or (b) construction of the building was— (i) approved, under this Act, before 1 January 1992; and (ii) started on or after 1 January 1992; or (c) an application for approval to construct the building— (i) was made, under this Act, before 1 January 1992; and (ii) the approval was given on or after 1 January 1992. 2 Standard Building Regulation 1993 , section 5 (Definitions)— “Queensland Development Code” means the Queensland Development Code published by the department as at 14 June 2002.
s7 4 s8 Building Fire Safety Amendment Regulation (No. 1) No. 151, 2002 2002 (2) The occupier must keep in the building, with the fire safety management plan for the building, a record of the evacuations containing the date and time of each evacuation. (3) The occupier must produce the record for inspection if requested by an authorised fire officer. Maximum penalty—10 penalty units. (4) In this section— “fire and evacuation plan” means a fire and evacuation plan maintained by the occupier under section 104E of the Fire Service Act.’. 7 Amendment of s 15 (Testing of special fire services) (1) Section 15(2)— insert ‘(c) for a budget accommodation building—keep a copy of the certificate of maintenance with the fire safety management plan for the building.’. (2) Section 15(4), after ‘maintenance’— insert ‘, or a copy of the certificate,’. 8 Amendment of s 16 (Testing of other prescribed fire safety installations) (1) Section 16— insert (2A) Also, if the building is a budget accommodation building, the occupier must keep a copy of the record of maintenance with the fire safety management plan for the building.’. (2) Section 16(4), after ‘maintenance’— insert ‘, or a copy of the record,’.
