Editorial changes

The Legislation Act 2001, part 11.3 authorises the Parliamentary Counsel to make editorial amendments and other changes of a formal nature when preparing a law for republication.  Editorial changes do not change the effect of the law, but have effect as if they had been made by an Act commencing on the republication date (see Legislation Act 2001, s 115 and s 117). The changes are made if the Parliamentary Counsel considers they are desirable to bring the law into line, or more closely into line, with current legislative drafting practice.

This republication does not include amendments made under part 11.3 (see endnote 1).

Uncommenced provisions and amendments

1. Name of regulation

   This regulation is the Building (Bushfire Emergency) Regulation 2004.

2. Notes

   A note included in this regulation is explanatory and is not part of this regulation.

3. Some building work approved

   (1)In this section:

   prescribed building means a building for which there is a plan of works endorsed under the Land (Planning and Environment) (Bushfire Emergency) Regulation 2003, section 9 (Endorsement of plans).

   (2)Building work on a prescribed building is taken to be approved if the work—

   (a)is work mentioned in the endorsed plan of works; and

   (b)is a development to which, under the Land (Planning and Environment) (Bushfire Emergency) Regulation 2003, section 7 (Certain developments exempted from Act, div 6.2), the Land (Planning and Environment) Act 1991, division 6.2 (Approvals) does not apply.
