Building and Plumbing Amendment Regulations 2024

The Governor in Council makes the following Regulations:

PART 1—PRELIMINARY

1Objective

The objective of these Regulations is to make consequential amendments arising from changes being made by the Building Legislation Amendment Act 2023—

(a)to amend the Building Regulations 2018—

(i)to prescribe kinds of work for the purposes of new section 169D; and

(ii)to make amendments to nomenclature; and

(b)to amend the Plumbing Regulations 2018 to make an amendment to nomenclature.

2Authorising provisions

These Regulations are made under sections 7, 9, 15A, 221ZZZV, 261 and 262 of, and Schedule 1 to, the Building Act 1993.

3Commencement

These Regulations come into operation on 1 February 2024.

PART 2—AMENDMENT OF THE BUILDING REGULATIONS 2018

4Division 2 heading in Part 18 amended

In the heading to Division 2 of Part 18 of the Building Regulations 2018[1], after "practitioner" insert "and prescribed work".

5Regulation 259 substituted

For regulation 259 of the Building Regulations 2018 substitute—

"259   Building surveyor work

A person who is registered under section 171(1)(a) of the Act in a class of building surveyor set out in Column 2 of the Table in Schedule 10 is authorised to carry out the work set out in Column 3 of that Table corresponding to that class of building surveyor and, for the purposes of section 169D(1) of the Act, that work is of a prescribed kind.".

6Regulation 260 substituted

For regulation 260 of the Building Regulations 2018 substitute—

"260   Building inspector work

A person who is registered under section 171(1)(a) of the Act in a class of building inspector set out in Column 2 of the Table in Schedule 11 is authorised to carry out the work set out in Column 3 of that Table corresponding to that class of building inspector and, for the purposes of section 169D(1) of the Act, that work is of a prescribed kind.".

7Schedule 9—Prescribed classes of building practitioners and prescribed qualifications

(1)In the heading to clause 5 of Schedule 9 to the Building Regulations 2018, for "draftsperson" substitute "building designer".

(2)In clause 5 of Schedule 9 to the Building Regulations 2018, for "draftsperson" substitute "building designer".

(3)In the heading to clause 7 of Schedule 9 to the Building Regulations 2018, for "person responsible for a building project" substitute "project manager".

(4)In clause 7 of Schedule 9 to the Building Regulations 2018, for "person responsible for a building project or any stage of a building project" substitute "project manager".

8Schedule 10—Work authorised to be carried out by a registered building surveyor

(1)In column 3 of item 1 in the Table in Schedule 10 to the Building Regulations 2018, for "Performance of all the functions that a building surveyor is authorised or required to perform" substitute "Any functions conferred on a building surveyor".

(2)In column 3 of item 2 in the Table in Schedule 10 to the Building Regulations 2018, for "Performance of all the functions that a building surveyor is authorised or required to perform" substitute "Any functions conferred on a building surveyor".

9Schedule 11—Work authorised to be carried out by a registered building inspector

(1)In column 3 of item 1 in the Table in Schedule 11 to the Building Regulations 2018, for "Performance of all the functions that a building inspector is authorised or required to perform" substitute "Any functions conferred on a building inspector".

(2)In column 3 of item 2 in the Table in Schedule 11 to the Building Regulations 2018, for "Performance of all the functions that a building inspector is authorised or required to perform" substitute "Any functions conferred on a building inspector".

(3)In column 3 of item 3 in the Table in Schedule 11 to the Building Regulations 2018, for "Performance of all of the functions that a swimming pool and spa inspector is authorised or required to perform" substitute "Any functions conferred on a swimming pool inspector".

PART 3—AMENDMENT OF THE PLUMBING REGULATIONS 2018

10What is plumbing work?

For regulation 12(2)(i)(iii) of the Plumbing Regulations 2018[2] substitute—

"(iii)a building designer; or".
