Building and Plumbing Amendment (National Construction Code and Other Matters) Regulations 2023

The Governor in Council makes the following Regulations:

PART 1—PRELIMINARY

1Objectives

The objectives of these Regulations are—

(a)to amend the Building Regulations 2018 to—

(i)update references to the Building Code of Australia; and

(ii)modify the application of certain provisions of the Building Code of Australia; and

(iii)make consequential and other amendments; and

(b)to amend the Plumbing Regulations 2018 to—

(i)update references to the Plumbing Code of Australia; and

(ii)clarify the adoption of certain plumbing standards; and

(c)to make consequential and other amendments.

2Authorising provisions 

These Regulations are made under sections 7, 9, 221ZZZV, 261 and 262 of, and Schedule 1 to, the Building Act 1993.

PART 2—AMENDMENT OF THE BUILDING REGULATIONS 2018

3Definitions

In regulation 5(1) of the Building Regulations 2018[1], for the definition of fire performance requirement substitute

"fire performance requirement means—

(a)performance requirement B1P1, D1P2, D1P3, D1P4 or D1P6 of the BCA Volume One (to the extent that it relates to fire safety); or

(b)performance requirement C1P1, C1P2, C1P3, C1P4, C1P5, C1P6, C1P7, C1P8, C1P9, D1P5, E1P1, E1P2, E1P3, E1P4, E1P5, E1P6, E2P1 or E2P2 of the BCA Volume One; or

(c)performance requirement H1P1, H3P1 or H3P2 of the BCA Volume Two (to the extent that it relates to fire safety for a Class 1b building or a Class 10 building not associated with a Class 1a building);".

4New regulation 10A inserted

After regulation 10 of the Building Regulations 2018 insert

'10A   Modifications to the BCA Volume One and BCA Volume Two

(1)The BCA Volume One applies as if—

(a)in Part F8, in the Notes before the heading "Objectives", for "30 September 2023" there were substituted "30 April 2024";

(b)in Part F8, in the Notes before the heading "Objectives", for "1 October 2023" there were substituted "1 May 2024";

(c)in Part J1, in the Notes before the heading "Objectives", for "30 September 2023" there were substituted "30 April 2024";

12Construction in termite risk areas

In regulation 151 of the Building Regulations 2018—

In this table—

amending regulations means the Building and Plumbing Amendment (National Construction Code and Other Matters) Regulations 2023;

BCA means the Building Code of Australia;

Building Code of Australia means the Building Code of Australia comprising—
