s1 2 s5 Building and Other Legislation Amendment Regulation No. 87, 2007 (No. 1) 2007 Part 1 Preliminary 1 Short title This regulation may be cited as the Building and Other Legislation Amendment Regulation (No. 1) 2007 . 2 Commencement Part 3 commences on 1 June 2007. Part 2 Amendment of Building Regulation 2006 3 Regulation amended in pt 2 This part amends the Building Regulation 2006. 4 Renumbering of s 51B (Prescribed day for expiry of existing rainwater tank provisions—Act, s 283) Section 51B— renumber as section 51C. 5 Insertion of new s 51B After section 51A— insert— ‘51B Approval of QDC part 14.1 ‘(1) QDC part 14.1 published by the chief executive on 31 January 2007 is approved under section 13(3) of the Act. ‘(2) The approval takes effect on 1 June 2007.’.

Part 3 Amendment of Integrated Planning Regulation 1998 7 Regulation amended in pt 3 This part amends the Integrated Planning Regulation 1998. 8 Amendment of sch 2 (Referral agencies and their jurisdiction) Schedule 2, table 1, items 1 and 2— omit, insert—

s8 4 s8 Building and Other Legislation Amendment Regulation No. 87, 2007 (No. 1) 2007 ‘Fire safety system—generally 1 A fire safety system for a building or structure, other than a temporary or special structure, if the building work— Queensland Fire and Rescue Service—as an advice agency (a) requires special fire services mentioned in schedule 2A, part 1; or (b) includes an alternative solution 1 assessed against the performance requirements of the Building Code of Australia, Volume 1, or the Queensland Development Code, part 14.1, for the fire safety system For the special fire services mentioned in schedule 2A, part 1—the matters mentioned in schedule 2A, part 2 For item 1(b)—the Building Act 1975 , chapters 3 and 4 Fire safety system—budget accommodation buildings 2 A fire safety system for a budget Queensland Fire and accommodation building if the Rescue Service—as an work involves a solution— advice agency (a) assessed against— (i) the performance criteria stated in the Queensland Development Code, part 14; or The fire safety management procedures under the Fire and Rescue Service Act 1990 (ii) the performance requirements of the Building Code of Australia, volumes 1 and 2, for the fire safety system; and (b) that includes fire safety management procedures as a condition of the use and occupation of the building

s8 5 s8 Building and Other Legislation Amendment Regulation No. 87, 2007 (No. 1) 2007 Residential care buildings 2A A residential care building under Queensland Fire and the Queensland Development Rescue Service—as an Code, part 14.1 advice agency For item A2 of the acceptable solutions stated in the Queensland Development Code, part 14.1—compliance with the Queensland Development Code, part 14.1, schedule 2 For item P2 of the performance criteria stated in the Queensland Development Code, part 14.1—the fire and evacuation plan for the building under the Fire and RescueService Act 1990 ’. 1 Building Code of Australia (2006 edition), part A1 (Interpretation), section A1.1 (Definitions)— Alternative Solution means a Building Solution which complies with the Performance Requirements other than by reason of satisfying the Deemed-to-Satisfy Provisions .
