s1 2 s4 Building and Construction Industry (Portable No. 311, 2000 Long Service Leave) Amendment (No. 1) ˙ Short title 1. This regulation may be cited as the Building and Construction Industry (Portable Long Service Leave) Amendment Regulation (No. 1) 2000 . ˙ Commencement 2. This regulation commences on 1 January 2001. ˙ Regulation amended 3. This regulation amends the BuildingandConstructionIndustry(Portable Long Service Leave) Regulation 1992 . ˙ Amendment of s 3A (Persons that are not eligible workers—Act, s 3A(2)(a)) 4.(1) Section 3A, heading, ‘3A(2)(a)’— omit, insert— 3A(3)(a) ’. (2) Section 3A(c), after ‘3A(1)(a)’— insert— ‘and (c)’. (3) Section 3A— insert— ‘(d) eligible workers mentioned in section 3A(1) of the Act who are engaged under a contract of employment with— (i) a local government; or (ii) a government entity.’.
s5 3 s8 Building and Construction Industry (Portable No. 311, 2000 Long Service Leave) Amendment (No. 1) ˙ Amendment of s 5 (Building and construction work for which no levy is payable—Act, s 70(2)(a)) 5. Section 5— insert— (2) Levy is not payable for building and construction work, or a part of building and construction work, if— (a) the work is to be carried out for— (i) a local government; or (ii) a government entity; and (b) all the persons to be employed on site in performing the building and construction work, or a part of the building and construction work, are persons employed under a contract of employment with the local government or government entity.’. ˙ Amendment of s 6A (Prescribed cost of work for which government entity must notify the authority—Act, s 76(2)) 6. Section 6A, ‘76(2)’— omit, insert— ‘76(3)’. ˙ Amendment of s 7 (Prescribed amount—Act, s 80(4)(b)) 7. Section 7, ‘80(4)(b)’— omit, insert— ‘80(5)(b)’. ˙ Amendment of s 8 (Working out additional levy—Act, s 80(6)) 8. Section 8, ‘80(6)’— omit, insert— ‘80(7)’.
