This regulation may be cited as the Building and Construction Industry (Portable Long Service Leave) Amendment Regulation (No. 1) 1995 . ˙ Commencement 2. Sections 4 to 6 commence on 1 October 1995. ˙ Regulation amended 3. This regulation amends the BuildingandConstructionIndustry(Portable Long Service Leave) Regulation 1992 . ˙ Amendment of s 6 (Long service leave levy) 4. Section 6, ‘0.3%’— omit, insert— ‘0.2%’. ˙ Amendment of s 8 (Working out additional levy—Act, s 70(6)) 5. Section 8(1), ‘0.3%’— omit, insert— ‘0.2%’. ˙ Amendment of s 10 (Working out refund—Act, s 71(2)) 6. Section 10(1) and (2), ‘0.3%’— omit, insert— ‘0.2%’.
s7 3 s7 Building and Construction Industry (Portable No. 249, 1995 Long Service Leave) Amendment (No. 1) ˙ Insertion of new ss 13–18 7. After section 12— insert— ˙ ‘ Application for appeal—Act, s 88(2) ‘ 13.(1) An appeal to an industrial magistrate must be started by filing an appeal form. ‘ (2) The form must be filed with the clerk of the Magistrates Court nearest to the place where the appellant resides or carries on business. ‘ (3) The appellant must state in the form— (a) the decision or matter appealed against; and (b) the material facts relied on in support of the appeal; and (c) the relief sought. ‘ (4) The clerk of the court must— (a) arrange with an industrial magistrate a return day and time for the appeal; and (b) notify the appellant of the availability of the appeal form for service. ‘ (5) In this section— “appeal form” means a form approved under section 18. “return day” means the day the parties are to attend before an industrial magistrate about the appeal. ˙ ‘ Service ‘ 14. An appellant must, after being advised of the availability of the appeal form for service, obtain the form from the clerk of the court and, at least 5 days before the return day, serve a copy of the form on the Authority and any other party to the appeal.
s7 4 s7 Building and Construction Industry (Portable No. 249, 1995 Long Service Leave) Amendment (No. 1) ˙ ‘ Conduct of appeal—Act, s 88(2) ‘ 15.(1) The rules of court under the Industrial Relations Act 1990 apply, with the necessary changes, to the following things in the same way they would apply to an appeal to the Industrial Court— (a) the way documents are served; (b) the way in which the appeal is to be conducted; (c) an industrial magistrate’s power to summon witnesses and documents. ‘ (2) An industrial magistrate may, for the circumstances of a particular case, make a directions order about the application of the rules. ‘ (3) Subsection (1) is subject to sections 13, 14 and 18. ˙ ‘ Where appeal is to be heard ‘ 16.(1) The appeal is to be heard by an industrial magistrate at the place the appeal form is filed unless— (a) an industrial magistrate at the place directs the appeal may more conveniently be heard by an industrial magistrate at another place; or (b) the parties agree the appeal may more conveniently be heard by an industrial magistrate at another place. ‘ (2) If a direction is made under subsection (1)(a) or the parties make an agreement under subsection (1)(b), an industrial magistrate at the place must adjourn the appeal and forward all relevant records to an industrial magistrate at the other place. ˙ ‘ Directions hearing or notice ‘ 17. An industrial magistrate may call a directions hearing or make a directions order for section 15 or 16— (a) on the application of a party; or (b) on the magistrate’s own initiative.
s8 5 s8 Building and Construction Industry (Portable No. 249, 1995 Long Service Leave) Amendment (No. 1) ˙ ‘ Approval of forms ‘ 18. The Chief Stipendiary Magistrate may approve the following forms for an appeal— (a) an appeal form for starting an appeal; (b) other forms for summonsing witnesses and documents.’. ˙ Renumbering of ss 12A–13 8.
