SERVICE PAYMENTS ACT 1986—REGULATION

(Relating to the National Metal and Engineering On-Site

Construction Industry Award)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Building and Construction Industry Long Service Payments Act 1986, has been pleased to make the Regulation set forth hereunder.

The Building and Construction Industry Long Service Payments

Regulation 1986 is amended:

(a) by inserting after item (v) of Part 2 of clause 4 (1) the following item:

(vi)  National Metal and Engineering On-Site Construction Industry Award 1989, as varied;

(b) by inserting after clause 4 (2) the following subclause:

(3) In the application of this clause to a registered worker, the National Metal and Engineering On-Site Construction Industry Award 1989 is prescribed in respect of work in the building and construction industry performed on or after the date on which the person became a regstered worker.

EXPLANATORY NOTE

The object of this Regulation is to amend the Building and Construction Industry

Long Service Payments Regulation 1986 so as:

(a) to add the National Metal and Engineering On-Site Construction Industry Award 1989 to the list of prescribed Commonwealth awards in clause 4; and
(b) to allow a person performing on-site construction work in the building and construction industry under this award to be registered as a worker under the Building and Construction Industry Long Service Payments Act 1986; and
(c) to provide that the benefits under the Act accrue to the person in relation to all such work performed on or after the person became a registered worker.

The effect of this Regulation is to extend the class of persons entitled to payments under the provisions of the Act to include metal workers performing on-site construction work. The date on which a person performing such work becomes a registered worker may be fixed retrospectively by the Building and Construction Industry Long Service Payments Corporation under section 18 (2) of the Act.
