Building Amendment Regulations (No. 2) 2004

Made by the Governor in Executive Council under section 433A of the

Act and section 9.60 of the Local Government Act 1995.

1. Citation
These are the Building Amendment Regulations (No. 2) 2004.

2.             Commencement

These regulations come into operation on the day on which Part 2 Jurisdiction) Amendment and Repeal Act 2003 comes into operation or on the day of their publication in the Gazette, whichever is the later.

3.             The regulations amended

The amendments in these regulations are to the Building
Regulations 1989*.

4.             Regulation 14 amended

Regulation 14(2) is amended by deleting “to appeal against the
refusal.” and inserting instead —
“

to apply to the State Administrative Tribunal for a

review of the refusal.

”.

5.             Schedule 1 amended

(1)	Schedule 1 Form 4 is amended by deleting “appeal to the Minister” and inserting instead —
“ apply to the State Administrative Tribunal for a review ”.
(2)	Schedule 1 Form 5 is amended by deleting “appeal to the Minister” and inserting instead —
“ apply to the State Administrative Tribunal for a review ”.

(3)	Schedule 1 Form 6 is amended by deleting “appeal” and inserting instead —
“ apply to the State Administrative Tribunal for a review ”.
(4)	Schedule 1 Form 7 is amended by deleting “appeal to the Minister” and inserting instead —
“ apply to the State Administrative Tribunal for a review ”.
