Building Amendment Regulations 2025

Made by the Governor in Executive Council.

1.Citation

These regulations are the Building Amendment Regulations 2025.

2.Commencement

These regulations come into operation as follows —

• (a)

  regulations 1 and 2 — on the day on which these regulations are published on the WA legislation website;

• (b)

  the rest of the regulations — on the day after that day.

3.Regulations amended

These regulations amend the Building Regulations 2012.

4.Regulation 48 amended

In regulation 48 delete the definition of pool barrier.

5.Regulation 50 amended

In regulation 50(2) delete “restricting access” and insert:

that restricts access to the pool and complies with the requirements of regulation 50A (and, if applicable, regulation 52)

6.Regulation 50A amended

In regulation 50A(1) and (4)(b) after “access” insert:

to the pool

7.Regulation 51 amended

  In regulation 51(2) after “access” insert:

   

to the pool

  In regulation 51(3)(c) delete “access.” and insert:

   

access to the pool.

8.Regulation 52 amended

Delete regulation 52(3) and insert:

• (3)

  The pool barrier required by regulation 50(2) may include a wall that contains a door permitting access to the pool through a building if that door satisfies the requirements of AS 1926.1-1993.

   

9.Regulation 53 amended

• (1)

  In regulation 53(1) delete “the provisions of regulations 50, 50A and 52 are” and insert:

  In regulation 53(2)(b)(i) delete “the provisions in regulation 50, 50A and 52 are” and insert:

  In regulation 53(2) in the note delete “the provisions in regulations 50, 50A and 52 are” and insert:

10.Regulation 53A amended

In regulation 53A(1) in the definition of re‑inspection delete “53(2)(b(i))” and insert:

53(2)(b)(i)

11.Regulation 54A amended

In regulation 54A(2) delete “complies with regulation 50” and insert:

restricts access to the pool and complies with the requirements of regulation 50A (and, if applicable, regulation 52)

12.Schedule 4 amended

In Schedule 4 clause 2 in the definition of fence delete “barrier as defined in regulation 48;” and insert:

barrier;

13.Schedule 6 amended

In Schedule 6 Division 2 delete the item relating to regulation 50(1) and insert:

r. 50(2) Failure to install compliant pool barrier around private swimming pool $1 000
