Building Amendment Regulations 2005

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under section 230 of the Building Act 2000 .21 February 2005

1Short titleThese regulations may be cited as the Building Amendment Regulations 2005 . 2CommencementThese regulations take effect on the day on which the Building and Construction Industry Training Fund Amendment Act 2004 commences. 3Principal RegulationsIn these regulations, the Building Regulations 2004 are referred to as the Principal Regulations. 4Regulation 9 amended (Effect of order in B landslip areas) Regulation 9(1)(a) of the Principal Regulations is amended by inserting "not" after "will". 5Regulation 14 amended (Reporting authorities) Regulation 14 of the Principal Regulations is amended by omitting "building permit" and substituting "certificate of likely compliance". 6Regulation 18 amended (Granting of building permits) Regulation 18(1) of the Principal Regulations is amended by omitting "grant" and substituting "consideration". 7Regulation 29 amended (Starting building work) Regulation 29(2) of the Principal Regulations is amended by inserting "from an owner builder" after "notification received". 8Regulation 52A insertedAfter regulation 52 of the Principal Regulations , the following regulation is inserted in Part 8: 52AWhen building permit levy is payable For the purposes of section 270(1)(a) of the Act, the prescribed amount is $12 000. 9Regulation 53 amended (Building permit levy) Regulation 53 of the Principal Regulations is amended by omitting " section 270 " and substituting " section 270(2)(c) ". 10Schedule 6 amended (Transitional and Savings Provisions) Clause 3 of Schedule 6 to the Principal Regulations is amended as follows: (a) by omitting "certificate" and substituting "permit"; (b) by omitting "6" and substituting "12".

EXPLANATORY NOTE

(This note is not part of the regulation) These regulations amend the

(a) increasing the amount prescribed for section 270(1) of the Building Act 2000 , with the result that a levy only becomes payable for building and related plumbing work if its estimated total cost exceeds $12 000; and (b) extending the period during which certain places of assembly are exempt from the requirement to have a new occupancy permit; and (c) making minor corrections.
