Building Act 1993

Building (Amendment) Regulations 2000

The Governor in Council makes the following Regulations:

1. Objective

The objective of these Regulations is to amend the

Building Regulations 1994 to—

(a)

revoke the special interest criteria for buildings; and

(b)

prescribe matters relating to the time limits for a responsible authority to respond to a request for a report and consent for demolition of a building or part of a building; and

(c)

increase the penalty for failing to provide a swimming pool barrier for existing swimming pools.

2. Authorising provisions

These Regulations are made under sections 7, 261 and 262 and Part 1 of Schedule 1 to the Building Act 1993.

3. Commencement

These Regulations come into operation on

1 November 2000.

4. Principal Regulations

In these Regulations, the Building Regulations

19941 are called the Principal Regulations.

5. Reporting authorities

(1) In regulation 2.2 of the Principal Regulations, in

Table 2.2—

(a)

in column 1, omit "Executive Director under the Heritage Act 1995";

(b)

in column 2, omit "Demolition or alteration of an historic or special interest building";

(c) in column 3, omit "reg. 2.2(5)".

(2) In regulation 2.2 of the Principal Regulations,

sub-regulation (5) is revoked.

6. New regulation 2.5 substituted

For regulation 2.5 of the Principal Regulations

substitute

"2.5 Time limits

The following time limits apply in relation to applications for building permits—

7. Safety of existing swimming pools

In regulation 5.13(9) of the Principal Regulations, for "5 penalty units" substitute "10 penalty units".
