BUILDING AMENDMENT REGULATIONS 1991

Made by His Excellency the Governor in Executive Council.

Citation

1. These regulations may be cited as the Building Amendment Regulations 1991.

Principal regulations

2. In these regulations the Building Regulations 1989* are referred to as the

principal regulations.

Regulation 4 amended

3. Regulation 4 of the principal regulations is amended—

(a)

in subregulation (1) by deleting the paragraph designation "(b)" in the second place where it occurs and substituting the following paragraph designation-

" (d) "; and

(b)

in subregulation (2) by inserting before "building" in the second place where it occurs the following-

" new ".

Regulation 5 amended

4. Regulation 5 of the principal regulations is amended in subregulation (2)-

(a) by inserting after "provisions" the following-

" of "; and

(b) by deleting "Council" and substituting the following-

" council ".

Regulation 31 amended
5. Regulation 31 of the principal regulations is amended in paragraph (a) (ii)

(a) immediately before 28 July 1989 was enclosed in accor- dance with the requirements of the Uniform Private Swimming Pool By-laws as they were then in force; and
(b) continues to be enclosed in accordance with those require-
ments. ".

by deleting "infected" and substituting the following-

" infested ".

Regulation 38 amended

6. Regulation 38 of the principal regulations is amended by—

(a) repealing subregulation (1) and substituting the following subregula- tion—

(1) Except as provided by this regulation, the owner or occupier of any premises on which there is a swimming pool shall cause that swimming pool to be enclosed by a fence, wall, or building or any combination thereof, in accordance with the provisions of these regulations.

Penalty: $5 000 and in addition a daily penalty of $250 for each

day during which the offence continues ";

and

(b) inserting after subregulation (3) the following subregulation-

" (4) This regulation does not apply to a swimming pool that—

Regulation 38A inserted

7. After regulation. 38 of the principal regulations, the following regulation is

inserted—

Maximum inspection charge

" 38A. For the purposes of section 245A (8) (b) of the Act the maximum charge

is $50. ".
