Building Amendment (Registration of Swimming Pools and Spas and Other Matters) Regulations 2020

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Building Regulations 2018—

(a)to change the dates—

(i)by which applications for registration of swimming pools or spas must be made; and

(ii)in relation to the lodgement or issue of certificates of pool and spa barrier compliance; and

(b)to change the date on which certain prescribed fees will be revoked.

2Authorising provisions

These Regulations are made under sections 7, 15A, 261, 262 and Schedule 1 of the Building Act 1993.

3Principal Regulations

In these Regulations, the Building Regulations 2018[1] are called the Principal Regulations.

4Application for registration of swimming pools and spas constructed, or where construction commenced, before 1 November 2020

(1)In the heading to regulation 147L of the Principal Regulations, for "1 June 2020" substitute "1 November 2020".

(2)In regulation 147L(1) and (2) of the Principal Regulations, for "1 June 2020" (wherever occurring) substitute "1 November 2020".

5Application for registration of swimming pools and spas constructed on or after 1 November 2020

(1)In the heading to regulation 147M of the Principal Regulations, for "1 June 2020" substitute "1 November 2020".

(2)In regulation 147M of the Principal Regulations, for "1 June 2020" (where twice occurring) substitute "1 November 2020".

6Application for registration of relocatable swimming pools and relocatable spas

For regulation 147N(2)(a) of the Principal Regulations substitute—

"(a)4 November 2020, if the relocatable swimming pool or relocatable spa was erected 3 or more days before 1 November 2020 and remains erected on 1 November 2020; or".

7Relevant council must give a notice to the applicant of registration of swimming pool or spa and certain other matters

(1)In regulation 147R(2)(a) of the Principal Regulations, for "1 June 2021" substitute "1 November 2021".

(2)In regulation 147R(2)(b) of the Principal Regulations, for "1 June 2022" substitute "1 November 2022".

(3)In regulation 147R(2)(c) of the Principal Regulations, for "1 June 2023" substitute "1 November 2023".

(4)In regulation 147R(5) of the Principal Regulations, for "June" (where twice occurring) substitute "November".

8Exemption from requirement to provide first certificate of pool and spa barrier compliance for certain swimming pools and spas

In regulation 147W(1) of the Principal Regulations, for "June" (wherever occurring) substitute "November".

9Issuing of certificates of pool and spa barrier compliance

In regulation 147Y(1) of the Principal Regulations, for "1 June 2020" substitute "1 November 2020".

10Revocation of regulations prescribing fees

In regulation 286 of the Principal Regulations, for "1 July 2020" substitute "1 July 2022".
