I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government (Administration) Act 1910.

An Ordinance to amend the Building Ordinance 1972

Short title

1. This Ordinance may be cited as the Building (Amendment) Ordinance

(No. 2) 1983}

Commencement

2. This Ordinance shall be deemed to have come into operation on

27 August 1982.

Principal Ordinance

1972.1 3. In this Ordinance, "Principal Ordinance" means the Building Ordinance
Derformance of functions under this Ordinance.

Appointment of Building Controller

4. Section 7 of the Principal Ordinance is amended by omitting sub-section

(3A).

5. After section 63 of the Principal Ordinance the following section is

inserted:

Legal liability for acts of Building Controller, etc.

"63A. (1) An action or proceeding, civil or criminal, does not lie against a person who is, or has been, the Building Controller, a Deputy Building Controller or a building inspector personally for or in respect of any act done or omitted to be done in good faith by him in the exercise of powers or the

"(2) Nothing in sub-section (1) shall be taken to affect any liability that the Commonwealth would, but for that sub-section, have in respect of an act or omission referred to in that sub-section.".
