BUILDERS' REGISTRATION.

No. 29 of 1966.

AN ACT to amend the Builders' Registration Act,

1939-1965.

[Assented to 27th October, 1966.]

RE it enacted by the Queen's Most Excellent

Majesty, by and with the advice and consent

of the Legislative Council and the Legislative

Assembly of Western Australia, in this present

Parliament assembled, and by the authority of the

same, as follows:—

Short title

1. (1) This Act may be cited as the Builders' and citation.

Registration Act Amendment Act, 1966.

1939-1965 is referred to as the principal Act.

Commence-

ment. 2. This Act shall come into operation on a date

to be fixed by proclamation.

amended. 3. Section two of the principal Act is amended by

adding after the interpretation, "Registrar" the

following interpretation

"Supervisor" means a person, not being a builder, who oversees the execution or performance of building work, but does not include a foreman, leading hand or other person employed in a like or less responsible capacity in the building industry.

amended.	4.	Section four of the principal Act is amended
(a) by adding after subparagraph (a) of paragraph (A) of subsection (1) the follow- ing paragraph-

(aa) construct for himself any building other than a dwelling house or a building comprising two dwellings on ground level, each being complete and self-contained, whether or not the building is so designed as to give an external appearance of a single dwelling; ;

(b)	by substituting for the words, "eight hundred pounds" in lines three and four of subparagraph (i) of paragraph (A) of subsection (1), the words, "two thousand four hundred dollars";
(c)	by substituting for the passage commencing with the word, "Penalty" in line thirty-two of subsection (1) and ending with the word, "conviction", being the last word in that subsection, the following passage

Penalty: For a first offence, not exceeding one hundred dollars; for a second or subsequent offence, not less one hundred dollars or more than two

hundred dollars and in either case if the offence consists of a contravention of subparagraph (b) of paragraph (A) of this subsection a further penalty not exceeding eight dollars for every day or part of a day during which the offence continues to be committed after any conviction; and

(d) by substituting for the words, "eight hundred pounds" in line three of paragraph (i) of subsection (3), the words, "two thousand four hundred dollars".

5. Section four A of the principal Act is amtded.

amended

(a)	by substituting for the words, "eight hundred pounds" in line three of paragraph (a) of subsection (1) the words, "two thousand four hundred dollars";
(b)	by substituting for the passage, "thereof." in line five of paragraph (c) of subsection (1) the following passage

thereof, and-

(i)    the building to which the permit relates is a dwelling house or a building comprising two dwellings on ground level, each being c o m p l e t e and self-contained, whether or not the building is so designed as to give an external appearance of one dwelling; and

(ii)    the person to whom the permit is issued has furnished the local authority with a statutory declara- tion verifying the fact that he has not, within the last preceding two years, obtained from that or any other local authority the issue of any other building permit pursuant to this paragraph. ;

(c)	by substituting for the word s, "ten thousand pounds" in line eleven of subsection (la), the words, "t wenty thousand dollars"; and
(d)	by substituting for the words, "fifty pounds" in line eleven of subsection (2), the words, "two hundred dollars".

amended. 6. Section ten of the principal Act is amended

(a)	by deleting subparagraph (ii) of paragraph (b) of subsection (1), and the word, "and" immediately following that subparagraph;
(b)	by substituting for the words, "twelve thousand five hundred pounds", being the last words in subsection (la), the words, "twenty-five thousand dollars";
(c)	by deleting subparagraph (ii) of paragraph (b) of subsection (lb); and
(d)	by substituting for the words, "twelve thousand five hundred pounds" in lines five and six of subparagraph (v) of paragraph (b) of subsection (lb), the words, "twenty- five thousand dollars".

amended. 7. Section ten A of the principal Act is

amended

(a)	by substituting for the word s, "ten thousand pounds" in lines eleven and twelve of paragraph (a) of subsection (3), the words, "twenty thousand dollars"; and
(b)	by substituting for the words, "Fifty pounds" in line twenty-one of subsection (4), the words, "Two hundred dollars".

8. Section ten B of the principal Act is amended amended.

(a)	by deleting from lines two, three and four of paragraph (b) the words, "and a statement that he is managing a n d supervising the work"; and
(b)	by substituting for the words, "One hundred pounds", being the last words in the section, the words, "Two hundred dollars".

9. Section ten C of the principal Act is amended— ?2:2cled.

(a)	by deleting from lines six and seven the words, "and a statement that he is managing and supervising the work"; and
(b)	by substituting for the words, "One hundred pounds", being the last words of the section, the words, "Two hundred dollars".

10. Section fifteen of the principal Act is amended by substituting for the words, "fifty pounds" in line twelve, the words, "two hundred dollars".	amended.

11. Section sixteen of the principal Act is amended by substituting for the words, "twenty pounds", being the last words of the section, the words, "fifty dollars".	amended.

12. Subsection (2) of section eighteen of the principal Act is amended by substituting for the words, "Fifty pounds", being the last words of the subsection, the words, "Two hundred dollars".	amended.

13. Subsection (2) of section nineteen of the 92?

principal Act is amended by substituting for the words, "twenty pounds", being the last words of the subsection, the words, "fifty dollars".

amended.	14. Section twenty of the principal Act is amended by substituting for the word, "president" in line three, the word, "chairman".

amended. 15. Section twenty-two of the principal Act is

amended

(a) by repealing subsection (2) and re-enacting it as follows

(2) The fees referred to in subsection

(1) of this section shall not exceed

(a)

for examinations—two dollars

for each subject;

(b)

for supplementary examinations —four dollars for each subject;

(c) for registration—four dollars;

(d)

for any certificate—twenty-five

cents. ;

(b)	by substituting for the words, "a fee of five pounds five shillings" in lines three and four of subsection (3), the passage, "such fee, not exceeding twenty-five dollars, as the Minister determines"; and
(c)	by substituting for the word s, "ten shillings" in the last line of subsection (3), the words, "one dollar".
