AN ACT to amend the Builders' Registration

Act, 1939-1953.

[Assented to 4th January, 1957.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-

1. (1) This Act may be cited as the Builders' 2,/ingtat,,

Registration Act Amendment Act, 1956.

(2) In this Act the Builders' Registration Act,

1939-1953,

Amendments Incorporation Act, 1938, with tat.nyywVed for

1948 incorporated, and as further amended by 1953.

Act No. 44 of 1953,

is referred to as the principal Act.

(3) The principal Act as amended by this Act may be cited as the Builders' Registration Act, 1939- 1956.

2. Section four of the principal Act is amended

(a)

by adding after the word, "builder" in line four of paragraph (B) of subsection (1), the passage, "—class A"; and

(b)

by substituting for the passage, " 'condi- tionally registered builder' ", in the passage added to subsection (1) by paragraph (b) of section two of Act No. 44 of 1953, the passage, " 'registered builder—class B' ".

3. Section four A of the principal Act is amended by substituting for the word, "four" in line seven of paragraph (d) of subsection (1), the word, "five".

4. Subsection (4) of section six of the principal

1953, a. 5 (a). Act is amended

(a)

by substituting for the words, "two pounds two shillings" in line four, the words, "three pounds three shillings"; and

(b)

by substituting for the words, "twenty-five pounds four shillings" in line seven, the words, "thirty-seven pounds sixteen shil- lings".

5. Section ten of the principal Act is amended—

three of subsection (1), the passage, "as a

registered builder—class A";

the passage added to paragraph (b) of sub- section (1) by paragraph (c) of section seven of Act No. 44 of 1953, the words, "for a period of at least seven years, or for periods aggregating at least seven years";

(c)

by substituting for the words, "prescribed examination" in line three of subparagraph (iv) of paragraph (b) of subsection (1), the words, "examination prescribed for appli- cants for registration as builders—class A"; and

(d)

by adding after the word, "number" being the last word in subsection (4), the passage, "and his class of registration whether class A or class B".

6. Section ten A of the principal Act is amended— 2;2:,tted

(a)

by deleting the word, "and" in line two of ggiV4of paragraph (b) of subsection (2);

(b)

by adding before the word, "is" being the first word in paragraph (c) of subsection (2), the words, "that he";

(c)

by adding after the passage, "character," being the last word in paragraph (c) of subsection (2), the word, "and", and the following paragraph

(d)

that he has completed the prescribed course of training including practical experience for a period of at least five years, or for periods aggregating at least five years, in the building industry and has passed the exam- ination prescribed for applicants for registration as builders—class B;

(d)

by substituting for the word, "four" in line thirteen of paragraph (a) of subsection (3), the word, "five"; and

(e) by adding the following subsection:

(5) Where immediately prior to the coming into operation of the Builders' Registration Act Amendment Act, 1956 a person was registered conditionally under the provisions of this section as enacted prior to the coming into opera- tion of that Act, he shall be deemed, unless

he notifies the Board to the contrary, to' have applied for registration under this section as a builder—class B, and he shall be deemed to be so registered and to con- tinue to be so registered unless in each year the first of which commences on the first day of January, one thousand nine hundred and fifty-seven,

(a)

he does not execute building work to the value of at least five thousand pounds inclusive of materials supplied and services rendered for the work: Provided that this paragraph shall not apply to any builder who for reasons which are satisfactory in the opinion of the Board has not during the pr eceding yea/ executed building work to the value aforesaid;

(b)

he does not pay the annual registration fee as required by subsection (3) of section twenty- two of this Act; or

(c)

he does not comply with the requirements of this Act in general so far as they relate to registered builders—class B, or of subsections (3) and (4) of this section in particular.
